EEOC Sues JC Penney for Disability Discrimination
JC Penney is being sued for denying a warehouse employee with breast cancer the time off she requested for treatment and then firing her when those absences counted against its strict attendance policy, which the EEOC says violates the ADA. The lawsuit seeks back pay, future pay, damages, and changes to JC Penney’s practices to prevent similar disability discrimination in the future.

EEOC Sues ALM Freight and LMDmax for Disability Discrimination
ALM Freight, an Amazon delivery partner, and LMDmax, the staffing and logistics company that supports its driver operations, are being sued after they revoked a job offer from a deaf applicant who asked for an ASL interpreter for orientation, which the EEOC says violated the ADA. The suit says both companies refused the accommodation and ended the hiring process.

Air Evac EMS to Pay $59,000 in EEOC Discrimination Lawsuit
Air Evac EMS, an air medical transport company, will pay $59,000 after withdrawing a job offer because an applicant used a prescribed medication, which violated the ADA. As part of the settlement, the company will also update its policies, train staff involved in hiring, and report on its compliance for the next two years.

Holsum Settles EEOC Disability Discrimination Lawsuit
Holsum of Fort Wayne, a bakery in Indiana, will pay $50,000 and update its policies after firing a long-time employee who needed a walker, which violated the ADA. The company will also provide ADA training and report on future accommodation requests for the next three years.

Justice Department Opens Investigation into SeaWorld Orlando, Busch Gardens Tampa Bay, and Aquatica Orlando for Disability Discrimination
The Justice Department is investigating United Parks & Resorts, which owns SeaWorld Orlando and Busch Gardens Tampa Bay, after complaints that the parks discriminate against guests with disabilities by banning rollator walkers. The agency says this may violate the ADA because some guests need these walkers to access the parks and the alternatives offered do not meet their needs.
