What a night! We were proud to host Women Leading Forward, bringing together clients, colleagues, and community leaders for an engaging and candid conversation on what leadership looks like in practice.
A special thank you to US Olympic Hockey Captain Hilary Knight and Massachusetts Governor Maura T. Healey for sharing perspectives grounded in real experience — from finding your leadership style to building trust with your team and showing up authentically, even in high-pressure moments.
A few themes resonated:

A recent win for companies using standard website technologies: a California court has issued a first-of-its-kind decision limiting the reach of the state’s Invasion of Privacy Act (C**A).
On May 27, 2026, the Los Angeles Superior Court dismissed, with prejudice, claims against our client, NetScout Systems, Inc., rejecting arguments that use of website software development kit (SDK) and data collection tools falls within the scope of C**A’s trap and trace or pen register provisions. In doing so, the court agreed with NetScout’s position that the statute was never intended to regulate routine internet activity, and instead only applies to telephone communications.
Why this matters:
This decision comes at a critical time, as companies face a growing wave of litigation targeting pixels, web beacons, SDKs, and other website technologies. It provides:
• Strong, persuasive authority to push back on similar claims
• A practical roadmap for defending against expansive interpretations of C**A
• A meaningful counter to efforts seeking to impose sweeping consent requirements on routine online data collection

AI misuse in drug manufacturing has triggered its first warning letter, an early signal the FDA is scrutinizing how AI is being used by regulated entities. This is one of several developments highlighted in the latest FDA in Flux newsletter.
• Proof-of-concept “real-time clinical trials” are now underway, with sponsors submitting endpoint data through digital platforms. These pilots signal a shift toward AI-enabled trial models designed to compress development timelines and move toward more continuous approaches.
• Scrutiny of drug compounding continues to intensify, including a proposal to exclude certain GLP-1 active ingredients from the 503B ingredient list and upcoming advisory meetings to evaluate certain experimental peptides for use by 503A compounders. These developments reinforce the current legal framework and the importance of compliance across 503A and 503B compounders.
• FDA is asking stakeholders to help identify drugs for potential repurposing where scientific data exists creating potential opportunities in underserved and rare disease areas.
• A new citizen petition challenges FDA’s disclosure of complete response letters and highlights the potential risks to proprietary information and competitive positioning.
