Today’s decision marks an important step toward correcting what should never have happened in the first place.

For over a year, Kseniia Petrova has maintained that CBP had no legal authority to cancel her visa on February 16, 2025. This week, the U.S. District Court in Vermont agreed, finding the cancellation unlawful: “The undisputed facts reveal that Ms. Petrova’s visa was impermissibly canceled.”

In December, Ms. Petrova also successfully challenged the government in the U.S. District Court for the District of Massachusetts, securing her right to work. Since January, she has been back in her lab at Harvard, pursuing her life’s calling and advancing important scientific research.

Today’s ruling makes clear that, as broad as CBP’s authority is at the border, its actions cannot be arbitrary or capricious. The United States remains a nation of laws – and those laws apply to all.

Hard to believe Livia just turned 15 (in Romanovsky Law years, that is). Thank you for a decade and a half of kindness, loyalty, and laughter!

Before you get too excited about the new immigration program announced by the White House earlier today, please remember that nothing has been implemented yet. We have to wait until the actual rule is published in the Federal Register and goes through the formal rule-making process, which will likely take several months.
Even though today’s announcement does mention some specific eligibility criteria (entry without inspection, 10 years in the U.S., marriage to a US citizen, etc.), we do not yet know whether the final rule will have the same parameters. And, most importantly, the rule will quite possibly be immediately enjoined by some federal court in Texas, so this new program may never see the light of day, after all.
