While employer-based visas such as the EB-1A and H-1B get most of the fanfare, there is another option that may help you open the door:

The O-1 visa is a temporary (non-immigrant) option for individuals with extraordinary abilities in business, education, athletics, science, or the arts.

And there are perks to this pathway:

– There is no lottery or annual cap on the number of O-1 visa approvals.
– You do not need a specific degree. Your experience and ability can stand on its own.
– It is eligible for premium processing.
– You can work for multiple employers (agent-sponsored), and you can change jobs without needing to reapply.

The O-1 also allows for dual intent, so you can pursue your permanent strategy while you work under the temporary visa, and it offers unlimited 1-year extensions after the initial 3-year approval.

It’s a smart option for individuals that might be struggling with getting an H-1B.

The June Visa Bulletin continues to show a “current” status under “Dates for Filing” for visas to sponsor your spouse and/or minor, unmarried children (F2A).

That means you can start the application process now.

This category of family visas has always had the lowest backlog (likely because it extends to immediate family members only), but the multi-country ban we’re currently under has expanded immigration opportunities in certain categories, and the F2A is benefiting from that shift.

That means you may be able to get your family here sooner than later. And that’s definitely good news!

My best advice? Take advantage of this window now, because it can close as quickly as it opened.

If you have acquired some “acclaim” in your field and you’re interested in branching out to do your own thing, the O-1 can be a good option to make that happen.

We work with entrepreneurs all the time who have reached a point where they’re ready to step out of the traditional employment arrangement and start their own business.
If you have reached a place of acclaim, meaning you’ve been recognized for your work, maybe you’ve published or won awards or you’ve been recognized for unique and impactful contributions, an O-1 could offer a streamlined pathway.

O-1s come with a number of perks, including the opportunity to work for multiple employers (agent-sponsored) or have paid side gigs related to your field of expertise.

There’s no lottery, no cap, and it offers unlimited one-year extensions.

You’ll need to be able to meet at least three of the eight criteria, but if you can, the O-1 could quickly open doors.

Just a reminder:

If you are tied to an employer-based immigrant petition, you need to be careful when trying to change jobs.

There are timing issues that may need to be addressed (among other things), so you absolutely need to talk to an immigration attorney, but it should not be your company’s legal counsel.

They cannot advise you on how to leave the company, because they represent the company, and anything you tell them could easily get back to the company. It’s a classic conflict of interest.

There’s also little expectation of confidentiality there, at least in terms of sharing information with your employer.

In fact, the only way to truly protect your interests is to find your own legal counsel. That’s something we highly recommend.
