FOIA Request for 109 late-arriving Vote by Mail ballot envelopes
To: supervisor of elections :
I am making a formal Freedom Of Information Act (FOIA) Request for the 109 ballot envelopes that contained the vote by mail (VBM) ballots that were posted to the Boca mayoral election night results after 100% of the in-person ballots were posted. These 109 late-arriving ballots were posted much later in the evening than the original batch of VBM ballots which were posted very shortly after the polls closed. As you know, the in-person voting results were substantially in my favor. These 109 late-arriving VBM ballots resulted in the election margin going from +25 for my candidacy to -6. This -6 margin was then reduced to -1 prior to the recount. These late arriving VBM ballots had a much larger vote skew towards Andy Thomson than the original VBM ballots that were reported shortly after the polls closed. As I understand from our conversations, your office may not be able to identify these particular 109 ballot envelopes. Therefore, this FOIA request includes all of the VBM ballot envelopes that were received and date-stamped into your office on March 10. We will then go through these date stamped ballots to review the time stamps for these ballots as they were entered into the counting machines to see which ones were the requested 109 late-arriving VBMs. This FOIA request also includes the particular location(s) where the VBM ballots that are date stamped as arriving on March 10 were obtained by your office, e.g. which post offices or particular designated official drop locations, and the number of VBM ballots obtained from each of these drop locations.
I am also making a formal Freedom of Information Request to identify the number of elections administered by your office over the last two years where some portion of the VBM ballots were counted and posted to the unofficial election night results after 100% of the in-person ballots were counted and posted, and the number of those late-posted VBM ballots in each election.
We would appreciate your expeditious processing of these FOIA requests. The results of these requests will enter into our decision to challenge or not the mayoral election results and it would be in the public’s interest if these requests were processed prior to the challenge time period expiring, so that we do not unnecessarily have to file a challenge due to having not received this information in a timely manner.
