The standard “As Is” Residential Contract for Sale and Purchase form approved by the Florida Bar has a section for the Buyer and Seller to provide their respective notice addresses in the event of a breach. Unfortunately, this section is rarely completed prior to signing. As a result, there can be significant delays when it comes to enforcement of these contracts because it’s unclear where to send a demand letter. While it usually impacts a seller’s claim on the buyer’s security deposit in the event of breach, a buyer can face similar issues when a seller who does not live in the property fails to timely close.
So what’s the lesson? Make sure that notice addresses for all parties are provided in the contract prior to signing. If you’re a realtor preparing the offer, gather the information and fill it in the blank space. You just might prevent a deal from falling apart.

Several new laws go into effect today in the State of Florida. This article contains a comprehensive list. Some notables: an anti-squatter law, prohibitions on the release of balloons, permission to sell larger single serving wine bottles and HOAs cannot regulate changes or decor to the inside of an owner’s home.

Breaking news! The FTC has voted to ban non-compete agreements. This will certainly help employees looking to accept new positions with a new employer. It’s expected that employer associations will file lawsuits in an attempt to stop the ban as it is not favorable to their business interests. The ban will likely go into effect 120 days after it is published in the Federal Register. Read more about the ban here:
