Over 200 ICE agents have come to New Orleans with a professed goal of arresting and detaining 5,000 people. Therefore I have the following advice to immigrants:

☑️ If you do not have a driver’s license, do not drive.
☑️ If you are an immigrant, do not ride as a passenger with an unlicensed driver.
☑️ You do not have to answer questions if detained by ICE.
☑️ If you have been in the United States for more than two years, keep evidence of your physical presence with you at all times and in various locations (photos on phone, car, home).
☑️ If you have ever had criminal charges against you dismissed or reduced, keep evidence of this with you at all times.
☑️ If you have any immigration work in process, keep the USCIS receipts or your court notice of next hearing with you at all times.
☑️ If you have an employment authorization card or permanent residence card, keep copies of those with you at all times and also keep copies on your phone, car, and at home.
☑️ If you are a non-white naturalized citizen, keep a photocopy of your U.S. passport or naturalization certificate with you at all times.
☑️ If you are a non-white native-born citizen, keep a copy of your birth certificate or passport with you at all times.
☑️ You are safest in your own home. You do not need to open your door to an ICE officer unless there is a warrant. I am also posting flyers to help you know your rights.
☑️ Arrange for a power of attorney to handle your financial affairs in case of detention.
☑️ Arrange for legal custody of your children in case of detention.
☑️ Arrange for people with legal status to take and pick up your children from school.
☑️ Save money for a lawyer and/or bond. If you entered without a visa you will not be given a bond but you may be able to file a petition in federal district court, which costs a lot more.
☑️ If you have a lawyer, memorize your lawyer’s telephone number and the telephone numbers of anyone else you want to contact if detained.

If you think you may have a defense against being deported, make sure you consult with an immigration lawyer. Give us call at 504-784-6803 today!

UPDATE RE: THE EXPANSION OF EXPEDITED REMOVAL | Wheatley Immigration Law, LLC 02/24/2025

In our blog regarding President Trump’s Executive Orders dated January 20, 2025, we discussed expedited removal. However, on Tuesday, January 21, 2025, the Trump administration expanded the expedited removal process. Traditionally, the law allowed the government to quickly deport undocumented immigrants without a hearing (1) who were arrested/detained within one hundred (100) miles of an international border or U.S. port of entry and (2) who were present in the country for less than two weeks. Under expedited removal, these undocumented immigrants who did not timely request asylum or failed to establish an asylum case could be deported without any hearing before an immigration court.
