In a recent New York federal ruling, a judge sent a clear message: your AI chats are not like talking to your lawyer.

A Dallas executive, Bradley Heppner, was under investigation. He used Claude to research legal questions and even fed in details his own attorneys had given him. When the FBI took his AI conversations, his lawyers argued they were confidential—like attorney–client communications.

The judge disagreed. In United States v. Heppner, the court said that conversations with AI are not privileged. They had to be turned over. It’s one of the first rulings of its kind in the country.

The reasoning was straightforward: AI isn’t a licensed lawyer, the tools don’t promise to keep your data private from the government, and sending something to your lawyer later doesn’t make it retroactively secret. The ruling also raised a bigger risk: putting your lawyer’s advice into an AI might waive privilege over that advice too.

Bottom line: For anyone using AI for legal work, strategy, or sensitive decisions—assume nothing you type is truly confidential unless you have a strong enterprise agreement that says otherwise. This applies in criminal cases, civil suits, and internal investigations.
