Thailand to Become First Southeast Asian Nation to Legalize Same-Sex Marriage.

Thailand is poised to become the first Southeast Asian nation to legalize same-s*x marriage following the Senate's overwhelming approval of a marriage equality bill with 130 votes in favor and four against. The bill now awaits the King's formal endorsement, before coming into effect 120 days after its publication in the Royal Gazette. This will make Thailand the third country in Asia to allow marriage equality, after Taiwan and Nepal.
The new law replaces gender-specific terms with gender-neutral ones, granting equal rights in marriage, child adoption, healthcare consent, and inheritance. It also allows LGBTQ+ individuals from any country to register their marriage in Thailand and provides foreign same-s*x couples with the right to a spousal visa. However, trans people will still be legally recognized according to their s*x assigned at birth.

In the context of purchasing a condominium in Thailand.

Property law mandates a number of specific documents that must be prepared for the transfer of ownership, especially for foreign individuals. Whether the transaction is facilitated by a project’s officer or an agent, or occurs directly between buyer and seller without a broker, the necessary paperwork typically includes the following:
For foreign individuals:

- A copy of the foreigner's ID card or passport, and a copy of the residence certificate for the renter and their dependents in the condominium.
- A copy of the notification form of the foreigner's stay, which has been acknowledged by the Immigration Bureau, which the juristic person officer can verify in case the renter exhibits suspicious behavior.
- In cases where the renter is a foreign person, they are permitted to reside in the condominium with no more than 3 persons per unit. Joint owners must provide the current renter's information to the management, and for safety and peacefulness, the management will conduct regular checks every 6 months.
- A certification letter of international fund transfer issued by a commercial bank, which must specify an amount sufficient for the condominium price in the foreign currency.
- If there are savings in Thailand, a certificate of deposit from the respective bank must be provided.

For individuals who are married:

- A copy of the passport of the spouse.
- A copy of the marriage certificate.
- A consent letter from the spouse.
- In cases of divorce, a copy of the divorce certificate.

It's important to note that if any of these documents originate from a country where the primary language is not Thai, they must be accompanied by a certified Thai translation.

In the absence of an agent, the buyer and seller must ensure that they have the correct and complete set of documents before proceeding to the Land Department for the official transfer of ownership. Buyers should make sure to consult with a lawyer or a legal expert in property law to make sure that all the paperwork is in order, as missing or incorrect documentation can delay or invalidate the property transfer process.

The rights of personal data owners, often referred to as data subjects, are critical to understand as they outline the privileges and claims these individuals have over their data. Here are the rights that safeguard data subjects from misuse by personal data controllers:

1. The right to be informed about the purpose, usage, and distribution of their personal data before or during the time of collection, including the intended use and the storage duration, by the data controller.

2. The right to access their data held by the data controller, provided it does not conflict with any laws or court orders, and without infringing on the rights and freedoms of others. Data subjects should be able to obtain a copy of their personal data.

3. The right to portability allows for the transfer of personal data from one data controller to another, as long as this does not violate any agreements or infringe upon the rights and freedoms of other individuals.

4. The right to object to the collection, use, or disclosure of their personal information by a data controller.

5. The right to request the deletion or destruction of their personal data that has been made public, in order to prevent potential identification of the data owner.

6. The right to withdraw consent for using their personal data at any time, subject to legal or contractual restrictions previously agreed upon.

7. The right to restrict the use of data or suspend its destruction after the expiration date, if it is required for legal proceedings or to assert a legal claim.

Who is responsible for personal data management?
This question arises to clarify the obligations and responsibilities of those in possession of personal data. The term "Data Controller" in personal data protection legislation is defined as an individual or legal entity with the authority and responsibility to decide on the collection, use, or disclosure of personal data.

From this definition, it is clear that whether the party is an individual or a legal entity that possesses personal data through any means, they have the power to disclose that information. Given the potential public dissemination of personal data, the law stipulates certain duties incumbent upon the data controller to prevent harm to the personal data owner:

1. The data controller must implement security measures to protect the personal data of individuals.
2. They must prevent the use or disclosure of personal data without consent.
3. They are required to arrange for the deletion or destruction of personal data once the retention period has expired.
4. If there is a breach of personal data, the data controller must notify the relevant data protection authority within 72 hours of becoming aware of the incident.

These responsibilities underscore the importance of due diligence by data controllers in safeguarding personal data and ensuring compliance with legal requirements, thereby respecting the privacy and rights of data subjects.

Residence Certificate

Residence Certificate is a document certifying where a foreigner resides. The Residence Certificate is required for obtaining and renewing driving licenses for both cars and motorcycles, as well as for buying/selling both cars and motorcycles.

One can apply for it at the Immigration Office where they have previously reported their stay in the kingdom for 90 days. Therefore, applicants must have received a visa that is valid for one year prior. If they have received a visa that is only valid for 3 months, they will not be able to apply for a residence certificate.

A report of foreigner's accommodation (T.M. 30) is also required as officials will send documents to the reported address.

The processing time for the application is two weeks.

"Knowing why the law aims to protect and the importance of personal data"

the next question arises: what exactly does the law protect? The purpose of legal protection is intended solely for ordinary personal data. This protection is not meant to extend to deceased individuals and organizations.

First, one must understand the definition of personal data. According to the Personal Data Protection Act, Article 6, personal data is defined as any information related to an individual that can be used to identify that individual, whether directly or indirectly. This does not include information about deceased individuals. From this legal definition, it is evident that such data often appears on social media or various online platforms. Information such as birth date, age, gender, or browsing history may be collected during platform registration or seen continuously, such as when applying for various membership cards. These can range from loyalty cards to gym memberships that require the applicant to provide their personal data.

Moreover, personal data is divided into two categories: general personal data and sensitive personal data.

General personal data includes: full names, telephone numbers, personal email addresses, current addresses, Identification numbers, passport numbers, driving license numbers, educational information, financial information, medical information, vehicle registration details, land title deeds, household registries, dates of birth, weights and heights, and any information visible on the internet.

Sensitive personal data, which is more delicate and could potentially harm the data owner in the aspects of work, society, and living conditions, requires special caution. Sensitive personal data includes: race, ethnicity, political opinions, religious or philosophical beliefs, s*xual behavior, criminal history, health data, disabilities (such as chronic illnesses), trade union information, genetic data, biometric data such as fingerprints, facial models, and retinal patterns.

According to the definition from Article 6 of the Personal Data Protection Act, whether it's general or sensitive personal data, it falls under the data that the law aims to protect. Therefore, it is the responsibility of the data custodian to protect this information adequately.

BOI Approves 41 Billion Baht in Projects, Focusing on EVs, Renewable Energy, and Tourism Infrastructure.
• The Thailand Board of Investment (BOI) approved investment projects valued at 41 billion baht (1.1 billion USD). These projects include electric vehicle (EV) manufacturing, renewable energy generation from waste, data centers, and travel and tourism infrastructure.
• Deputy Prime Minister Parnpree Bahiddha-Nukara led the meeting and also refined the five-year investment promotion strategy initiated earlier this year. The adjusted strategy focuses on five key industries for the next four years (2024-2027), including Bio-Circular-Green (agriculture, food, medical, and clean energy), EV manufacturing, electronics (particularly smart electronics), digital and creative sectors, and regional business hubs.
• In the first eight months of 2023, the BOI received investment applications worth 465 billion baht, a 47% increase from the same period the previous year. The number of applications rose by 33%, totaling 1,375 projects.

According to the Condominium Act B.E. 2522. Purchasing a condominium is not nationality restrictations. Foreigner also have the same rights as Thai people but foreigners can only purchase a unit located in the Freehold Section only 49% of the building total space. All funds used to purchase the condo must be transfered in foreign currency and must come from abroad. Unless you are foreigner who has been working in Thailand and paid taxes on the monies earned. You are then permitted to purchase a condo by the money you earned in Thailand. The Title Deed of the condo will show the foreigner's name and prove ownership of the unit.
