A question we receive a lot is... What works can be carried out in Portugal without obtaining a building licence from the Town Hall?
Under Articles 6 and 6-A of the RJUE, certain works may be exempt from licensing, provided that they meet the legal requirements applicable to the property, location and type of intervention.
Examples include:
🔹 Conservation works (maintenance, repairs, restoration and cleaning)
🔹 Interior alterations, provided they:
Do not alter the exterior appearance of the building; and
Do not affect the building's structural stability.
🔹 Reconstruction works, where the original form, façades, volumes, openings and roof are substantially maintained.
Small annexes, such as storage rooms or sheds:
• Maximum area: 10m²
• Maximum height: 2.2m (or the ground-floor ceiling height of the main building)
• Not facing a public road.
Boundary walls up to 1.8m high that do not front a public road, and retaining walls up to 2m high that do not significantly alter existing topography.
🔹Garden greenhouses up to 20m² and under 3m in height.
Minor landscaping and external improvement works that do not affect public domain areas.
🔹Leisure and recreational structures associated with the main building, such as pool equipment rooms or play areas, provided they remain subordinate to the principal building.
🔹Solar panels, thermal solar systems, battery storage units and small wind turbines, subject to the dimensional limits established by law.
🔹Replacement of windows, doors, roof coverings and exterior cladding where the external appearance remains identical while improving energy efficiency.
⚠️ Important: Exemption from licensing does not necessarily mean exemption from other obligations.
Depending on the circumstances, you may still need:
🔹 To notify the municipality before works commence;
🔹Technical declarations from qualified professionals;
🔹 Heritage approvals;
🔹 Compliance with municipal planning regulations and other legal restrictions.
