Gender-Fair Language in Every Pleading: RA 11313's Mandate, Our Professional Duty

As future lawyers, using inclusive and gender-fair language isn’t just a best practice. It’s a legal and ethical requirement. RA 11313 mandates that all pleadings, court documents, and legal arguments avoid gendered assumptions and consistently reflect gender-fair language. This aligns with our professional responsibility under the Code of Professional Responsibility to uphold the Constitution and all laws, including those promoting human dignity and safe spaces.

Every word we write in legal documents and every statement we make in court should honor this mandate, making inclusivity and respect for all genders a standard, non-negotiable part of legal practice.

Our Words Shape Justice: Future Lawyers Champion Gender-Fair Language Under RA 11313

Gender-fair language, as mandated by RA 11313, is fundamental to achieving justice. Lawyers have a professional responsibility to use inclusive language in all legal practice. This includes all legal documents, pleadings, oral arguments, and professional communications.

Under RA 11313, the legal mandate for gender-fair language is clear: Section VI.A.2 of the IRR requires the government to use non-discriminatory language in all official communications, while Sections III.B.2 and XII.B emphasize promoting gender-fair and gender-sensitive legal practice by using inclusive language in all legal documents, pleadings, oral arguments, and professional communications, and by modeling gender-fair language in every written and oral communication.

Justice begins with the words we choose.

Let us all lead by example.

This Awareness Campaign on the use of gender-fair language under the Safe Spaces Act is an initiative of Group 6 of Gender Sensitivity and Laws on Women and Children class of Philippine Law School.

It is part of our continuing effort as future members of the Philippine Bar to promote respectful, inclusive, and empowering communication in all spaces.

By raising awareness on how everyday words can either uplift or harm, we aim to encourage communities to adopt language that honors human dignity, prevents gender-based harassment, and supports the rights and safety of women, children, and all individuals.

Through this advocacy, we hope to spark conversations, inspire positive change, and contribute to a culture where everyone feels seen, respected, and protected.
