DILG Central Luzon underscores the important role of City and Municipal Local Government Operations Officers (C/MLGOOs) in supporting the proper implementation of the Katarungang Pambarangay (KP) system and promoting the rule of law at the community level.
At the frontline of local governance, C/MLGOOs guide and support barangay officials in the proper conduct of mediation and conciliation proceedings. From issuing summonses to facilitating hearings, they ensure due process under Republic Act No. 7160 or the Local Government Code of 1991, strengthening transparency, accountability, and public trust in community-based justice.
While the Lupon Tagapamayapa or Pangkat does not have the authority to physically compel individuals to appear, the law provides clear consequences for unjustified non-appearance.
Under Section 515 of the Local Government Code, any party or witness who refuses or willfully fails to appear despite a valid summons may be cited for indirect contempt of court. Penalties, as determined by the appropriate municipal or city court, may include fines or imprisonment.
In addition, failure to appear may result in procedural consequences. A complainant who does not attend the proceedings may be barred from filing the same case in court, while a respondent may be precluded from filing counterclaims arising from the same matter.
These provisions reinforce the importance of participating in barangay conciliation processes, which remain a vital first step in resolving disputes within communities.
DILG Central Luzon stands with every DILG Field Officer who continues to do the hard, often unseen work of upholding due process, guiding our barangays, and keeping our justice system working at the grassroots. Their courage, integrity, and commitment deserve not just recognition but respect.
