If a Buyer purchased a unit on a private subdivision or on a condo development, a regular monthly HOA Fee is required. The Fee is to maintain the garbage, security, swimming pools, road maintenance, etc. It is for the benefit of the homeowners and to assure them that the value of their property will not go down. When a development is already owned by a majority of homeowners, the developer must surrender the entire development to the homeowners thru the HOA.

In the Philippines, the concept of HOA is relatively new. Most HOA does not know their rights, (even developers, HOA is still vague to them). After a few years, in most cases, you see a private subdivision with no more security guards, roads not being maintained, dirty swimming pools, etc. This is mostly due to a weak HOA. Homeowners don’t pay the dues anymore because the “other” neighbors are not paying their dues. In most cases, there are no provisions in the HOA By Laws on how to enforce the collection of dues.
