Recently i saw a video where a Nigerian Police Officer is asking a dispatch rider to open a sealed food package, as in he wants to see the food itself and the dispatch rider was worried that the customer will not accept it again.

Who go accept food package wey dem do open

The questions here now is this

Does a Police 0fficer has the right to ask a dispatch rider to open a sealed packaged food during stop and search operation

What is the Position of the Law?

Secrion 49, sub section 2 of the Police Act gives them the legal power to search anyone on reasonable suspicion without a search warrant that moment

BUT SECTION 50 of the same Police Act gave some reasons to validate the suspicion

1. The Police Offcier must question the suspect about his behaviors or his presence in circumstances that gave rise to the suspicion

2. If the person to be searched has a satisfactory explanation which makes the search unnecessary, no search may take place

3. Before the Police Officer search the person

The Police Officer must give the person his Name by showing his ID and the name of the Police Station he is attached to and His reason for the search
M

In summary

If the Police Officer did not follow the rules above before conducting the search and asking the rider to open a sealed Food package.

Get the evidence with your Body camera or your phone or M£ta glass or any other cam

The rider and the company he works for can SU£ the Police Offcier for

1. Trespass to Goods
2. Breach of fundamental human right

and demand for Damages of 50 Million Naira only.
