Think removing the logo makes your "dupe" legal? A federal jury just disagreed.
In the landmark case of Nike v. Divide the Youth (DTY), the verdict was clear: you canāt hide behind a different logo if the "Look and Feel" of your product is a carbon copy. This is called Trade Dress, and it protects the unique silhouette and design that makes a brand recognizable.
The big takeaway?
1. For Brands: "Inspired by" is a dangerous legal tightrope. Use original designs to avoid confusion and liability.
2. For Influencers: Promoting "reps" or sharing affiliate links for lookalikes can lead to Contributory Counterfeiting. Yes, you can be held liable for the brandās total damages.
