The Local Government Director General, 'Mating Mahoana, has been dismissed from civil service following a disciplinary process initiated by the former Principal Secretary in the Ministry of Local Government, Chieftainship, Home Affairs and Police, Mpopo Tšoele.

The disciplinary hearing was instituted shortly before Tšoele was removed from office amid a fallout with the then Minister of Local Government, Chieftainship, Home Affairs and Police, Lebona Lephema.

Sources familiar with the matter said Mahoana became defiant after being served with a show-cause letter by Tšoele, arguing that she was not answerable to him because they were of the same grade and enjoyed equal authority. Tšoele subsequently instituted disciplinary proceedings against her.

When the hearing commenced, Mahoana did not attend. Instead, she reportedly submitted a medical certificate to the Human Resources department rather than the chairperson of the disciplinary tribunal. The hearing therefore proceeded in her absence.

In a last-minute bid to halt the process, Mahoana rushed to court this morning on an ex parte application seeking an order barring the chairperson from delivering the verdict.

However, the court directed her to serve the respondents and return at 2pm, the same time the disciplinary tribunal had scheduled for the delivery of its ruling.

The verdict was consequently delivered this afternoon, resulting in Mahoana's dismissal.

Chief Justice Sakoane Sakoane has sentenced former members of the Lesotho Defence Force (LDF), Sergeant Tjekane Sebolai and Corporal Selone Ratšiu, to 20 years' imprisonment for the murder of Lesebo Tang and a further 10 years for the attempted murder of Tšepo Jane.

The pair were also handed an additional four-year sentence for the malicious damage of a vehicle in which Tang and Jane were travelling.

The sentences are to run concurrently.

The convictions stem from a 2014 shooting incident in which Tang was killed and Jane seriously injured while the soldiers were on guard duty at the residence of then LDF Commander Lieutenant General Tlali Kamoli.

In delivering judgment, Chief Justice Sakoane rejected the accused's defence that they were merely acting under orders. The court found that the soldiers had a duty to assess whether the instructions they received were lawful and consistent with the law.

The defence had argued that a security alert had been issued at the time, requiring members of the special forces to respond with lethal force rather than warning shots. However, the court ruled that this did not absolve the accused of criminal responsibility.

The landmark ruling brings to a close one of the country's most closely watched cases linked to the political and security turmoil that gripped Lesotho in 2014.
