UK IMMIGRATION UPDATE

On 5 March 2026, the UK Government published HC 1691 – Statement of Changes to the Immigration Rules, introducing a series of reforms across work migration, sponsorship routes, criminality thresholds, and asylum processes. Many of the headline changes come into force on 26 March 2026 and form part of the government’s wider immigration reforms following the 2025 Immigration White Paper.
Here’s a breakdown of the key updates:
1️⃣ Sponsorship & Skilled Worker route
From 26 March 2026, Afghan nationals will no longer be able to apply for Skilled Worker entry clearance from outside the UK.
Importantly, Afghan nationals already in the UK are not affected by this restriction.
2️⃣ Student visa restrictions
Nationals of Afghanistan, Cameroon, Myanmar, and Sudan will no longer be able to apply for Student visas from overseas. The Home Office has introduced this measure in response to concerns about asylum claims being made through migration routes.
3️⃣ Work restrictions for asylum seekers
Asylum seekers who are allowed to work after waiting more than 12 months for a decision will now be limited to RQF Level 6+ roles, bringing the rule in line with the Skilled Worker skill threshold.
4️⃣ Tougher criminality rules
The changes tighten refusal and cancellation rules where an individual has a UK conviction resulting in a suspended sentence of 12 months or more. This aligns with provisions under the Sentencing Act 2026 and expands the scope for refusal and deportation decisions.
5️⃣ Asylum and further submission rules
New procedural rules now apply to claims and further submissions made on or after 2 March 2026 (excluding unaccompanied asylum-seeking children) with the new grant-of-leave approach applying to decisions made from 26 March 2026.
Applications may now be rejected or treated as withdrawn if the required conditions are not met.
