The haircut that never was: Need to factor in whether a loan account had become an NPA while assessing haircut from its resolution under IBC 06/08/2021

The Report of the Parliamentary Standing Committee on Finance had criticised IBC as deviated from its original goals and flagged the haircuts taken by lenders as a major concern. However, a key stakeholder of the IBBI had countered this by delay factor.

The haircut that never was: Need to factor in whether a loan account had become an NPA while assessing haircut from its resolution under IBC A delay in initiating the insolvency process also means that creditors, because of their unhappy experience, are more inclined to take back their money with whatever haircut comes about and make their exit.

The Second Edition of IBC16’s Bi-Monthly Blog Writing Competition is here!

We are thrilled to inform you that we received an enthusiastic response to our first Blog Writing Competition. To continue with our endeavor of encouraging analytical scholarship, which braves the unexplored areas of insolvency law, we are pleased to announce the Second Edition of our Bi-Monthly Blog Writing Competition.

IBC16 invites submissions from students for blog posts exclusively covering the NCLT and NCLAT orders/judgments from the months of July and August 2021. The authors are encouraged to explore topical theme(s) in insolvency law, through novel analysis of the judgment(s)/order(s) chosen.

NO PARTICIPATION FEES WILL BE CHARGED.

Deadline for the submission is 10 September 2021 (11:59 PM).
