Divorce law in India is not governed by a single uniform framework-it operates through different personal laws, each prescribing distinct grounds, procedures, and remedies.
Here’s a comparative overview of divorce under Hindu and Muslim law:
🔹 Under the Hindu Marriage Act, 1955
• Either spouse can seek divorce
• Grounds include cruelty, adultery, desertion, conversion, mental disorder, and more
• Mutual consent divorce under Section 13B is one of the most commonly invoked provisions
🔹 Under the Dissolution of Muslim Marriages Act, 1939
• The statute primarily enables wives to seek dissolution of marriage
• Grounds include non-maintenance, disappearance, imprisonment, cruelty, impotence, etc.
• Remedies like Khula and Mubarat continue to hold significant legal and practical relevance

• Leprosy and venereal disease are no longer recognised as grounds for divorce after the 2019 amendment
