Vishakha versus State of Rajasthan was a landmark judgment delivered by the Supreme Court of India in 1997.

The Court held that workplace sexual harassment violates the fundamental rights of women under the Constitution of India.

The case arose after the assault of Bhanwari Devi, a social worker from Rajasthan.

Since no specific law existed at that time, the Supreme Court created the Vishakha Guidelines.

These guidelines required employers to ensure a safe working environment and establish complaint committees.

The judgment later became the foundation for the Sexual Harassment of Women at Workplace Act, 2013

In an April 2026 ruling, the Allahabad High Court (Lucknow bench) held that the transgender community (kinnars) has no legal right to demand "badhai" or "neg"—customary money/gifts on auspicious occasions. The court noted such demands lack legal sanction and can be considered extortion under the Bharatiya Nyaya Sanhita.
