Conjugal rights in prisons refer to a prisoner’s right to physically meet their spouse, aiming to preserve emotional bonds, family life, and human dignity beyond virtual contact. Such visits help reduce stress, improve behaviour, support rehabilitation, and are closely linked to Article 21 rights like dignity, intimacy, and procreation. While many countries recognise conjugal or extended family visits as a humane prison practice, India lacks a uniform national policy, though some High Courts have permitted them in specific cases.
The article argues that recognising conjugal rights in India is especially important given the large number of undertrial prisoners, as it would protect spouses’ emotional well-being, reduce prison violence, strengthen family support, and promote reform over punishment. Thiruvenkadam's case from Kerala highlights the gap between legal principles and practice, reaffirming that emotional closeness and family life are integral to the right to life and dignity under Article 21.

പോക്സോ കേസ് പ്രതി ജയിലിൽ മരിച്ചനിലയിൽ
റിമാൻഡിലായ പോക്സോ കേസ് പ്രതിയെ കാസർകോട് സബ് ജയിലിൽ മരിച്ച നിലയിൽ കണ്ടെത്തി. ദേളി കുന്നുപാറയിലെ മുബഷീർ (30) ആണ് മരിച്ചത്.

ശാരീരിക അസ്വസ്ഥതകളെ തുടർന്ന് ആശു പത്രിയിൽ പ്രവേശിപ്പിച്ചെന്നാണ് ജയിൽ അധി കൃതർ പറയുന്നത്. കാസർകോട് ജനറൽ ആശുപത്രിയിൽ എത്തിച്ചപ്പോഴേക്കും മരിച്ചിരുന്നു. മരണത്തിൽ സംശയം പ്രകടിപ്പിച്ച് കുടുംബം രംഗത്തെത്തി. കുറെ വർഷമായി ഗൾഫിലായിരുന്നു മുബഷീർ. നാട്ടിലെത്തിയപ്പോൾ വിദ്യാനഗർ പോലീസ് സ്റ്റേഷനിൽ 2016-ൽ രജിസ്റ്റർ ചെയ്ത പോക്സോ കേസി ലാണ് പോലീസ് അറസ്റ്റ് ചെയ്തത്.

ദേഹോപദ്രവം ഏൽക്കുന്നതായും അമിതമായി ഗുളികകൾ നൽകുന്നതായും രക്ഷപ്പെടുത്തണമെന്നും മുബഷീർ പറഞ്ഞിരുന്നതായി കുടുംബം ആരോപിക്കുന്നു.
പ്രാഥമിക പോസ്റ്റ്‌മോർട്ടം റിപ്പോർട്ടിൽ മൃതദേഹത്തിൽ ഏതെങ്കിലും പരിക്ക് കണ്ടെത്താനായില്ലെന്നും ഹൃദയാഘാതത്തിന്റെ സാധ്യത ഡോക്ടർമാർ തള്ളിക്കളഞ്ഞുവെന്നും വ്യക്തമാക്കുന്നു. മരണകാരണം കൃത്യമായി കണ്ടെത്തുന്നതിനായി ആന്തരാവയവങ്ങൾ ഫോറൻസിക് പരിശോധനയ്‌ക്കായി കണ്ണൂരിലെ പരിയാരം മെഡിക്കൽ കോളേജിലേക്ക് അയച്ചിട്ടുണ്ട്.
കുടുംബത്തിൻ്റെ പരാതിയിൽ കാസർകോട് ടൗൺ പോലീസ് കേസെടുത്തു.

2022 ൽ നടന്ന അവസാന NCRB സർവേയുടെ കണക്ക് പ്രകാരം 1,995 മരണങ്ങൾ ആണ് ഇന്ത്യൻ ജയിലുകളിൽ നടന്നിട്ടുള്ളത്. കേരളത്തിൽ മാത്രം 32 മരണങ്ങൾ. പലപ്പോഴും മാനസിക സംഘർഷങ്ങളും പീഡനങ്ങളും ജയിലുകളിൽ ജനസംഖ്യ കൂടുന്നതും ഈ മരണങ്ങൾക്ക് ആക്കം കൂട്ടുന്നു.

സുതാര്യവും കൃത്യവും ആയ ഒരു അന്വേഷണം ഇപ്പോൾ നടന്ന മുബഷീർന്റെ മരണവുമായി ഉണ്ടാകേണ്ടതാണ്.

വിയ്യൂർ ഹൈസെക്യൂരിറ്റി ജയിലിൽ മുഹമ്മദ് അസറുദ്ദീൻ, മനോജ് എന്നിവർക്കാണ് മർദ്ദനമേറ്റത്.
വൈകുന്നേരം ലോക്കപ്പിന്റെ സമയത്ത് ജയിൽ ഉദ്യോഗസ്ഥർ അസറുദ്ദീനെ തെറി വിളിച്ചതും മതം ചൂണ്ടിക്കാട്ടി മോശമായി പെരുമാറിയതിനെ മനോജും അസറുദ്ദീനും ചോദ്യം ചെയ്തതിൽ അവരെ 2 മണിക്കൂറോളം ക്രൂരമായി മർദ്ദിക്കുകയും മനോജിനെ പൂജപ്പുര സെൻട്രൽ ജയിലിലേക്കും അസറുദീനെ കണ്ണൂർ സെൻട്രൽ ജയിലിലേക്കും മാറ്റി. മനോജ് മർദ്ദിച്ചവർക്കെതിരെ നടപടി എടുക്കണം എന്നാവിശ്യപെട്ട് നിരാഹാരത്തിലാണ്.

മനോജിന് ഇടത് കണ്ണിന് സാരമായ പരിക്ക് പറ്റിയിട്ടുണ്ട് ശരീരമാസകലം മുറിവുകളും പരിക്കും ഉണ്ട്. അസറുദീന് ഇത് വരെ ചികിത്സ പോലും ലഭ്യമാക്കിയിട്ടില്ല. മനോജിനെ മനുഷ്യാവകാശ പ്രവർത്തകരും, അസറുദീനെ പിതാവും സന്ദാർശിച്ചു.

ഇത് ആദ്യമായല്ല കേരളത്തിലെ ജയിലുകളിൽ നിന്ന് കസ്റ്റഡി മർദ്ദനങ്ങളുടെ വിവരങ്ങൾ പുറത്ത് വരുന്നത്.

2023ൽ വിയ്യൂർ സെൻട്രൽ ജയിലിൽ തടവുകാര്‍ക്ക് ഡെപ്യൂട്ടി ജയിൽ സൂപ്രണ്ടിന്‍റെ നേതൃത്വത്തിൽ മർദ്ദനം ഏറ്റിരുന്നു.

മറ്റൊരു തടവുകാരന്റെ ദേഹത്ത് ജയിൽ ഉദ്യോഗസ്ഥൻ തിളച്ച വെള്ളമൊഴിച്ചു അതിൽ മനുഷ്യാവകാശ കമ്മീഷൻ കേസെടുത്തത്തിരുന്നു.

ഇവരെ മർദ്ദിച്ചതിൽ പ്രതിഷേധിച്ച് ഹൈസെക്ക്യൂരിറ്റി ജയിലിൽ സന്തോഷ്, കാർത്തി എന്നീ തടവുകാർ നിരാഹാരത്തിലാണ്.
1. പ്രസ്തുത സംഭവവുമായി ബന്ധപ്പെട്ട തടവുകാർക്ക് ജയിലിൽ നിന്നും മർദ്ദനമേറ്റെന്നും മർദ്ദിച്ചവരായ ഉദ്യോഗസ്ഥർക്കെതിരെ നടപടി വേണം.
2. തടവുകരോട് അന്തസോടെ പെരുമാറണം, ആയതുമായി ബന്ധപ്പെട്ട് സർക്കുലറിറക്കി നോട്ടീസ് ബോർഡിൽ പ്രദർശിപ്പിക്കണണം.
3. തടവുകാരുടെ സെല്ലുകൾ പകൽ മുഴുവൻ തുറന്നിടണം.
4. ഉദ്യോഗസ്ഥരുടെ ജോലിഭാരം കുറക്കും വിധം അവരുടെ തസ്തികകൾ വിർദ്ധിപ്പിക്കണം.
5. തടവുകാരുടെ സുരക്ഷിതത്വം ഉറപ്പ് വരുത്തണം.

എന്നീ ആവശ്യങ്ങൾ ഉന്നയിച്ചുകൊണ്ടാണ് ഇവർ നിരാഹാരം കിടക്കുന്നത്.

കസ്റ്റഡി മർദ്ദനങ്ങളുമായി ബന്ധപെട്ട് ഒട്ടനവധി കോടതി വിധികൾ ഉണ്ടെന്നിരിക്കെ ജയിൽ ഉദ്ദ്യോഗസ്ഥർ ഇത് തുടരുന്നത് കൃത്യമായ താക്കീതുകളോ നടപടികളോ ഉണ്ടാകാത്തത് കൊണ്ടാണ്.

ഇവിടെ, കാത്തിരിക്കും ഞാൻ പുലർവെളിച്ചത്തിൻ്റെ ചിറകുകൾക്കായി വീണ്ടും നനവാർന്ന കൺപോളകളിൽ പ്രത്യാശയുടെ ഒരുകൂട്ടം ഊഷ്‌മളരശ്മികൾ ഒപ്പിയെടുക്കാനായി.

The Kerala High Court, through Justice P.V. Kunhikrishnan, has directed prison authorities to grant a life convict 10 days of ordinary leave to attend his mandatory LL.B. internship. The petitioner, serving a sentence under Section 302 IPC, is pursuing a three-year law course at KMCT Law College, Kuttippuram, and required physical attendance for his internship scheduled from September 10 to 16 of 2025

The convict's plea came after the prison authorities failed to act on his request for leave. Referring to the precedent in Pattakka Suresh Babu v. State of Kerala (2024), the court held that education is a part of reformation and that prisoners are entitled to temporary leave for academic requirements. The court rejected the State's reliance on Balamurali N. v. Inspector of Police (2025) and ordered the prison to grant leave from September 9 to 18, 2025, upon ex*****on of a ₹1,00,000 bond with two sureties.

The Kerala High Court on Tuesday (10th June) issued an order granting 7 days leave to a convict prisoner for taking admission to his child to 11th standard.

The mother of the child initially approached the prison authorities for securing the parole first. However, it was denied saying that there is no provision for such a release. Subsequent to that, she approached the High Court.

On Court's direction, the mark list of the child was produced before the Court. He had secured 6 A+ and 2 A in SSLC Examination. Justice P. V. Kunhikrishnan said that it cannot shut its eyes to the request of such a bright kid who is seeking the help of his father to get admission to higher studies after arranging fees and other things.
