Trinity Chambers is looking to recruit a part- or full-time administration assistant to resource an office project. Likely to be 3-6 months’ work at the most, so would suit a school leaver or university student during the summer vacation. Flexi-time, work as many or as few hours as you like, excellent hourly rate of pay.

Guardianship and Lasting Powers of Attorney

It can be a worrying time when an elderly relative becomes physically or mentally infirm and unable to look after themselves. It imposes a strain on that person’s carer, and the strain can be all the greater where the carer is put in the position of having to cover their relative’s living and care expenses.

Lasting Powers of Attorney

Since 2022 Guernsey residents have been able plan ahead for a circumstance where they might lose capacity by registering a Lasting Power of Attorney (“LPA”) with the Greffe. An LPA enables an individual to delegate responsibility to their chosen Attorney(s) to manage their financial affairs for them. LPA’s also introduced the ability to appoint an individual to manage health and welfare matters on their behalf, which extends further than the responsibilities of a traditional guardian.

Many people have taken up the option of preparing LPA’s since their introduction, with many choosing to do so at the same time of preparing Wills. However, the forms have more intricacies than many initially envisaged and are beginning to witness occasions in practice where they have not met their intended purpose due to the manner in which they were prepared.

We are happy to provide advice in preparing or amending an LPA (whether at the time of preparing Wills or independently) and are always happy to provide a fixed fee quote for your consideration before starting work.

Guardianship

In circumstances where an individual has not prepared an LPA and has lost capacity a Guardianship Order is required.

Being appointed as a guardian allows you to manage the financial affairs of the person under guardianship, subject to strict legal safeguards which should give comfort to the rest of your family. We can assist with applications to the Royal Court for guardianship, and advise on related issues such as the sale of realty owned by the person under guardianship.

MEET THE TEAM - Advocate Mark Priaulx

Mark qualified as a Guernsey Advocate in 2016 and has a day to day focus in general practice with a predominantly local focus.

Mark has established a broad client base and assists individuals, families and businesses in dealing pragmatically with the legal requirements that arise in day-to-day life. Mark’s daily work is varied and includes advice on Will drafting, preparing Lasting Powers of Attorney, Estate and Probate advice, Population Management and Employment law advice, and also includes advising on applications to the Royal Court for personal appointments such as Guardianship orders, Guernsey realty administration orders and liquor licences.

He is also able to advise in contentious matters such as estate disputes, building disputes, evictions and has experience in debt recovery including enforcing debts against real property through the customary law Saisie process.

Outside of work he is kept busy by his three young children and has a keen interest in local football, both coaching and playing when time allows.

MEET THE TEAM - Jacqui Crispini

Jacqui joined Trinity Chambers LLP in August 2021, bringing with her 28 years of experience in the Guernsey legal sector.

Throughout her career, Jacqui has acquired a wealth of knowledge in Corporate and Company Administration, Will drafting, Estate Administration and Bond work.

As a member of the Conveyancing Team, Jacqui provides representation for both vendors and purchasers in their conveyancing transactions, utilising her knowledge and skills to guide clients through the process with ease.

In her spare time, Jacqui is a keen traveller. When her out of office is on, you can presume she is off on another amazing adventure.
