We recently submitted an application for two Defined Certificates of Sponsorship (CoS), both of which were approved within 24 hours, a notably quick turnaround given the current climate. In recent months, the process has become increasingly challenging, with the Home Office applying much stricter scrutiny to applications. Despite this, the successful outcome has been extremely positive for the client, who is delighted to now move forward with recruiting two skilled workers from overseas. This approval will play an important role in supporting the business’ growth and operational needs.

We represented our client, who initially entered the UK as a visitor, in securing her right to remain as an elderly dependent relative. From the outset, we provided strategic guidance and comprehensive support throughout the application process. Following the refusal of her initial application, we successfully advocated on her behalf at appeal. The Tribunal allowed her case, recognising that her removal from the UK would constitute a disproportionate interference with her family life, given her reliance on her children residing here. We were delighted to secure a successful outcome in this human rights appeal, ensuring our client can remain in the UK with her family. Having arrived as a student, she became an essential source of care and stability for her British citizen brother’s two young daughters following the tragic death of their mother. The Tribunal accepted that her role went far beyond that of a relative. The judge stated that “clear and persuasive evidence [was provided to show]… that the appellant has stepped into the shoes of parent” and that she is involved in the children’s lives “to such a degree that it can be properly characterised as parental in nature” . In allowing the appeal on Article 8 human rights grounds, the Judge concluded that “there is no public interest in the appellant’s removal.” This decision clearly recognises the profound importance of family life and the best interests of the children.
