New major family law changes are coming in May 2024.

The purpose behind this reform is to make sure the best interests of the child remain as the key focus of parenting proceedings.

It will make the application of law to these circumstances a little easier to navigate.

There is no automatic starting point or presumption that the asset pool should be divided equally in all instances.

The Court will assess each matter on its merit and will take a number of things into consideration.

MEET OUR NEW TEAM MEMBER - MICHAEL!

Michael graduated from Murdoch with a Bachelor of Laws Honours in 2022. To complete his Practical Legal Training, he initially volunteered with Gosnells Community Legal Centre before working as a Legal Associate in the Family Court of Western Australia.

He will be admitted to practice in May 2024. Michael is excited to start his legal career in earnest with Lighthouse Legal and looks forward to eventually becoming an Independent Children’s Lawyer.

In his spare time, Michael enjoys writing, photography, and gin.

We will be taking a well deserved break over the Christmas holiday from the 22nd of December and will re open on the 3rd of January 2024.

The Family Court of WA has introduced an expedited process for property settlement applications filed after the 1st October 2023.

A PPP500 Case is one where:

🔹 the net value of the property of the parties (excl super) is or appears to be under $500,000;
🔹 No entities (such as a family trust, company or SMSF) owned or in control of either party that might require valuation or expert investigation, and there are otherwise no elements of complexity involved in the case;
🔹 The Court makes a declaration that the proceeding is designated as a PPP500 case.
