Writing in Accountancy Today, Partner Kate Gee and Senior Associate Oliver Steeple explore the Financial Reporting Council’s recently revised auditing standards and what they could mean for the future of audit negligence litigation.
Kate and Oliver examine the FRC’s changes to ISA (UK) 240 and ISA (UK) 570, which reinforce auditors' obligations to address fraud and assess going concern, and consider how the revised standards may influence the assessment of auditor conduct in future commercial disputes.
Their article also discusses the potential impact on key litigation issues, including scope of duty, causation, and disclosure, as well as the role the new standards may play in shaping judicial and public expectations following corporate failures.

Paralegal Olivia Ward and Partner Tom Snelling comment in relation to White v Uber, in which the High Court in London ruled on Friday 12 June 2026 that communications between a litigation funder and claimant solicitor firms (concerning whether or not to fund a litigation) were not covered by litigation privilege.
Addressing the scope of litigation privilege in the context of litigation funding, this judgment is important for both claimants seeking litigation funding and defendants seeking to challenge group claims.
