⚖️ Το Εφετείο αλλάζει τα δεδομένα: Η άρνηση παράδοσης κατοχής πλέον διώκεται ποινικά

📅 Στις 31/10/25, το Εφετείο Κύπρου στην Ποινική υπόθεση αρ. 94/2022, έκρινε ότι μετά τον σαφή τερματισμό της ενοικίασης από τον Ιδιοκτήτη η παραμονή του ενοικιαστή μετά τον τερματισμό στο ακίνητο συνιστούσε ποινικό αδίκημα αφού κατείχε γη εγγεγραμμένης επ’ ονόματι άλλου προσώπου χωρίς τη συναίνεση του κατά παράβαση του Άρθρου 281(1)(α) του Ποινικού Κώδικα, Κεφ. 154

🇬🇧 On 31/10/2025, the Cyprus Court of Appeal, in Criminal Case No. 94/2022, ruled that once the landlord had unequivocally terminated the tenancy, the tenant’s continued occupation of the property thereafter constituted a criminal offence. This was because the tenant was in possession of land registered in the name of another person without that person’s consent, in breach of Article 281(1)(a) of the Criminal Code, Cap. 154.
