Is a mediated Separation Agreement legally binding?
Yes, once it gets signed. A mediated agreement is initially called a Memorandum of Understanding and is not signed or legally binding. To make it legally binding, a mediator or lawyer changes the title and adds a signature section. Now it’s a Separation Agreement, which becomes legally binding once it has been signed by all parties.

Did you know that Mediation is voluntary, confidential, and non-adversarial?
Mediation is an approach to dispute resolution that succeeds by facilitating parties as they work together to generate their solutions. Having an open conversation in a safe environment allows participants to understand better what really matters to one another.

"We've tried to talk already. Why should we mediate?"
If “kitchen table” conversations are productive, there is no need to pay to bring in a third party.
But most people aren’t trained in conflict communication. Tempers get hot. Voices rise. People stop listening to one another. They don’t know all the decisions that need to be made in a separation.
That’s when a trained facilitator can make a world of difference.
