"Judge Rouleau further pressed Lametti directly, saying as a result of the lack of disclosure of that legal opinion — which convinced the director of Canada’s spy agency to advise Prime Minister Justin Trudeau to go ahead and invoke the Emergencies Act — he was having “trouble” reaching a clear understanding of the “reasonableness” of the government’s decision which he noted is a part of his mandate, “when we don’t know what they were acting on.”

So much for transparency, eh?

Following a two week hearing involving a Charter ss.7 and 8 challenge to a search warrant, my client prevailed in demonstrating that a key sub-affiant subverted the pre-authorization process, resulting in a finding that my client's Charter Rights were very seriously violated and the exclusion of 2 kg of co***ne, 3 fi****ms, ammunition and $400,000 in cash from his trial. Thanks to William Joynt Investigations for his incredible legwork in the prepation phase of this complex piece of litigation.

After 13 days of evidence on a difficult and complex Charter application in person, the crown conceded the application today and the inadmissibility of the subject evidence at trial. Having completed a 7 week Virtual Trial via WebEx during the pandemic and this matter in person, I am reaffirmed in my view that there is no real substitute for in person confrontation of witnesses in the physical presence of a judge, in spite of the great outcomes achieved in both cases. The energy and dynamic of an in person courtroom case is simply not reproduceable on a computer monitor with a headset on. Let's start focusing on keeping safe in person courtroom spaces open and available this Fall and Winter. Stay safe everyone.
