After 13 days of evidence on a difficult and complex Charter application in person, the crown conceded the application today and the inadmissibility of the subject evidence at trial. Having completed a 7 week Virtual Trial via WebEx during the pandemic and this matter in person, I am reaffirmed in my view that there is no real substitute for in person confrontation of witnesses in the physical presence of a judge, in spite of the great outcomes achieved in both cases. The energy and dynamic of an in person courtroom case is simply not reproduceable on a computer monitor with a headset on.
