Most chain-of-custody records prove the chain. Far fewer prove the custody. That gap is the first thing defense counsel goes after.
A traditional record shows how an item was submitted, stored, and disposed of. What it often misses is proof that the evidence was physically secure the entire time: which compartment it went into, under what access controls, in what storage environment, and who was authorized to open it.
We published five evidence management best practices for agencies working to close that gap, including:
