With new privacy requirements now in effect in Western Australia, and further federal changes coming in December 2026, now is a very good time for businesses to review how they collect, store, use and share personal information.

For real estate businesses in particular, we hold a significant amount of personal information across clients, tenants, landlords, employees and applicants. And compliance is about much more than simply having a privacy policy sitting on your website.

Businesses should be asking:
• Is our privacy policy actually up to date?
• Do our day-to-day processes match what our policy says?
• Where is personal information being stored and shared?
• Are we using AI or automated systems to make decisions involving people?
• Are our suppliers and third-party providers handling data appropriately?

The upcoming federal changes around AI and automated decision-making are particularly important, with greater transparency requirements applying from December 10, 2026.
