🚨 Australian Colleges Warned: “Do Not Try to Game” Student Visa Rules

Private colleges have issued nearly 3,000 last-minute enrolments into a Graduate Diploma of Management (Learning) course that is being cancelled from 5 October 2026.

According to the regulator, since the ban was announced on 4 September:
📌 1,300+ new enrolments were issued
📌 1,500+ future enrolments were brought forward

Assistant Minister for International Education Julian Hill has warned education providers and agents against attempts to circumvent the new rules.

Authorities are closely examining unusual enrolment patterns, including arrangements where students may appear to be studying multiple full-time courses simultaneously.

🎓 Important for students: Officials have warned that entering a non-genuine study arrangement could put a student’s current or future visa at risk.

The government says genuine students should receive clear advice and quality education—not arrangements designed primarily for commercial benefit.

🇦🇺 TASMANIA SKILLED MIGRATION UPDATE – SEPTEMBER 2026

Tasmania has released its latest Skilled Migration invitation and processing update for Subclass 190 and Subclass 491.

🔹 63 invitations issued
• Subclass 190: 37 invitations
• Subclass 491: 26 invitations

📊 Lowest invitation scores
• Subclass 190: 375 points
• Subclass 491: 72 points

⚠️ Important: The invitation score should not be confused with the score used during nomination assessment.

Current assessment thresholds are reported as:
• Subclass 190: 504 points
• Subclass 491: 83 points

Applicants should ensure that all claimed priority attributes and points are accurate and supported by evidence. Receiving an invitation does not automatically guarantee Tasmanian nomination.

🚨🇦🇺 Australia Tightens Oversight of International Student Recruitment

Australia has launched its first mandatory data collection on education agent commissions, bringing greater reporting requirements to providers recruiting international students.

The Department of Education opened the new collection through PRISMS on 21 September 2026, covering commissions and benefits provided between 1 January and 30 June 2026.

🔎 Key points for education providers:

🔹 All CRICOS-registered providers must respond, including those that paid no agent commissions.
🔹 Providers with no reportable commissions must submit a nil return.
🔹 The reporting deadline is 30 October 2026.
🔹 The requirement is established under the Education Services for Overseas Students Act 2000 (ESOS Act).
🔹 Failure to comply with a valid information request may constitute an offence and can attract penalties under the legislation.

The new reporting system forms part of broader Australian regulatory oversight of the international education sector and financial arrangements between education providers and student recruitment agents.

The Department has also released factsheets to assist providers with completing the collection and advised organisations to refer to the ESOS Act, National Code and official Department of Education guidance where questions arise.

🎒 New Backpacker Ballot | 🚫 Crackdown on Visa Hopping | 🎓 Changes for International Students | 👷 Skilled Migration Priorities

Australia’s migration system is set for a significant overhaul, with the Federal Government announcing a range of proposed changes aimed at reducing net overseas migration, strengthening visa compliance and better aligning migration with Australia’s workforce needs.

Home Affairs Minister Tony Burke has outlined several important measures that could affect international students, graduates, Working Holiday Makers, skilled migrants, visa overstayers, visitors and migration agents.

🔹 KEY PROPOSED CHANGES

🎒 Working Holiday Maker – New Ballot System

The Government plans to introduce a ballot-style system for some Working Holiday Maker arrangements.

The number of people able to remain in Australia for a second and third year would also be reduced:

• Around 45,000 people would be able to stay for a second year.
• Around 5,000 would be able to stay for a third year.

This represents a reduction from the previous numbers.

🎓 International Students & Family Members

New restrictions are proposed for international students and graduate visa holders bringing family members to Australia.

There will be some exceptions, including provisions for certain PhD students.

📚 Stricter Rules for Student Visa Extensions

Students seeking to extend their stay would generally need to demonstrate progression to a higher-level qualification—for example, moving from a Bachelor’s degree to a Master’s degree.

🚫 Crackdown on “Visa Hopping”

The Government is also targeting arrangements where people repeatedly move between different visa types to extend their stay in Australia.

A proposed “No Further Stay” condition on visitor visas is another significant measure. This could restrict certain visitors from applying for another visa while remaining in Australia.

👷 Priority for Critical Workforce Areas

The proposed migration settings would give greater priority to workers in sectors identified as important to Australia’s workforce needs, including:

• Construction
• Agriculture and farming
• Fisheries
• Mining
• Teaching

🏗️ Changes to the Skilled Migration Points Test

The skilled migration points system is also expected to be revised, including recognition of relevant construction qualifications alongside traditional university qualifications.

This could be particularly relevant to skilled workers with qualifications and experience in construction-related occupations.

⚠️ Action Against Visa Overstayers

The Government says there are approximately 77,000 people in Australia who have overstayed their visas.

Compliance and enforcement measures are expected to increase, including potential detention for people who remain in Australia unlawfully.

👩‍💼 Stronger Action Against Rogue Migration Agents

The Government also plans to strengthen its powers against migration agents who knowingly assist with applications that do not have merit.

This could include stronger penalties and action against agents who breach migration rules.

🎯 WHY IS THE GOVERNMENT MAKING THESE CHANGES?

The Government’s stated objective is to reduce migration-driven population growth and make Australia’s migration system more targeted toward current economic and workforce requirements.

The Government has set a target of reducing migration-related population growth from approximately 292,100 to 245,000 in the year to July 2027, followed by a longer-term figure of around 225,000 per year.

However, these numbers and policy proposals remain part of an ongoing political and parliamentary process, and not every announced measure necessarily becomes law immediately.
