Are bad terms worse than no terms at all?
Good question. Depending on what jurisdiction you are in and the applicable laws and regulations, you may be muddying the waters with poorly crafted T&C’s. Not all terms are equal! To have a check or a second set of eyes, contact us today.
Confirming in writing. The advice I usually give clients if in doubt is to confirm in writing. We had a case recently where terms were ambiguous on permission to use Copyright information and content. Permission in writing beyond the terms will usually help in this situation. It will at the very least reduce some of the uncertainty. Again if you have any specific queries just let me know.
This came up again this week, so let’s discuss it, Dual Jurisdiction. Dual Jurisdiction: the process of naming two (or sometimes more) jurisdictions in a contract. I would recommend against this as I’ve seen the outcome as an Adjudicator. Best case, its messy. Worse case, it leads to delays and high costs of dispute resultion. So give your contract a Contract Health Check today and make sure you have this point covered.
