Contract of sale of land!
A contract of sale of land is a legally binding document that is required when buying or selling a house in Australia that contains the terms and conditions agreed upon between the parties in a property transaction. The property is sold once both parties sign the contract of sale. The contract of sale contains details of the property such as the buyer and seller’s names, agent details, details of legal representatives, purchase price, deposit to be paid, balance owing at settlement, any goods sold with the land, settlement date, any special condition such as a ‘subject to finance’ clause etc. A contract of sale should be drafted and prepared on your behalf by your legal representative, such as a licensed conveyancer.

What is a Vendor’s Statement and when do you need one? A Vendor’s Statement - also known as a Section 32 Statement - is a legal document that is required by law to be given by a seller (the vendor) to a potential purchaser prior to a purchaser signing a contract of sale. The statement provides and contains information to prospective purchasers about the property’s title, this information includes things such as:
- mortgages
- covenants
- easements
- zoning
- outgoings, such as rates etc.
- whether the property may be in a bushfire prone area.
This information assists purchasers to make more informative decisions when considering making an offer to purchase a property. A Vendor’s Statement is required at the time of deciding to sell your property and usually prepared by your legal representative, such as your conveyancer.

What does a conveyancer do?
A conveyancer can:
- prepare and review necessary legal documents such as leases and contracts.
- provide advice on conveyancing documents.
- communicate with lenders.
- prepare mortgages.
- advise on stamp duty implications and prepare the relevant SRO forms.
- Arrange financial adjustments.
- prepare settlement statements.
- transfer property ownership.
- attend settlement.
