The Bill was gazetted on 1 August 2022, and proposes the following amendments to the Electricity Act:
Mandatory minimum sentence of 10 years imprisonment for abstraction or diversion of electricity or damage or destruction of electrical equipment;
Mandatory minimum sentence of 10 years imprisonment for offenses relating to transporting material used for generating, transmitting, or supplying electricity. Again, there will be an in the absence of special circumstances;
Remove the option to pay a fine on offenses of Transportation of material used in connection with generation, transmission, distribution or supply of electricity, unless there is exceptional circumstances;
There is a provision for the Court to consider exceptional circumstances, which might be exempted from these stiffer penalties, enabling the court to impose a lesser penalty of a fine of “up to or exceeding” level 14 or imprisonment for up to 10 years.
