Congratulations to Attorneys Neil Pedersen and Jennifer Santillan for procuring a $250,000 settlement for an employee who wanted to return to work following medical leave but was denied simple accommodations and was eventually terminated because the employer claimed she could not work.

Bad news for high earning employees: Starting 1-1-22 the maximum earnings subject to Social Security tax will increase from $142,800 to $147,000. The cap just 5 years ago was $127,200.

The Dept. of Labor has just issued a "final rule" regarding tipped employees. However, although better for employees in most states, California's Labor Code is much better for CA tipped employees.

Like CA, the DOL final rule just issued prohibits managers and supervisors from participating in a tip pool or keeping employees' tips.

The new DOL final rule on tipped employees allows tips to reduce the employer's minimum wage obligation. California does not allow for any tip credits.

Big Changes for Employee Leave in CA!

The rights of CA employees to leave for medical conditions of their own and their close family members has been greatly expanded by the enactment of SB 1383. Those rights now exist for employees of employers of just 5 or more employees, not just large employers as it was before the change.

New Law Provides Right to Attorney Fees for Employee Retaliation Claims

Governor Newsom just signed into law AB 1947 adding a right to recover attorney fees for employees who seek redress for being retaliated against for complaining about or standing up against unlawful actions by their employer.

Prior to January 1, 2020, California employees had no effective protection against an employer who paid them late. Under new California law, effective 1-1-20, employees now have the right to bring a legal or administrative wage claim to seek not only their pay, but penalties for the failure to pay on time. SB 688, 673.
