Federal Law Alert: OSHA Form 300A Must Be Posted by February 1
Employers that had 11 or more employees at any point in 2021 are required to post Occupational Safety and Health Administration (OSHA) Form 300A from February 1 through April 30 unless they qualify as an exempt low-risk industry.
The employee count is based on the number of employees in the entire company, not per establishment. If the company is subject to routine recordkeeping requirements, records must be maintained for each physical establishment.
All covered employers are required to post Form 300A even if they didn’t have any recordable incidents in 2021. OSHA Form 300A must be certified by a company executive and posted in a conspicuous location where notices to employees are customarily posted.

As you may have heard, the newly enacted COVID-19 relief bill provides additional tax credit opportunities for businesses in 2021. These credits include the Employee Retention Credit (ERC) – a potential tax credit of up to $7,000 per employee, per quarter. Congress has also improved and expanded the ERC program to cover employers with less than 500 employees.
These potential tax credits could be quite significant for your company. If either of the situations listed below apply to you, contact us and Alliance can help manage the complexities of the ERC:
- A government restriction or shutdown impacted your business.
- Your business revenues were down by over 20% in any quarter from 2019-2020.
Please be aware that the full details of how to claim the credit haven't been released yet since the 7200 form is only valid for 2020 wages; however, we can begin calculating the credit amounts for your company if you decide to use our ERC service. As soon as the IRS releases guidance on claiming the tax credit, we will create all required documentation and file the necessary forms on your behalf.

FEDERAL LAW ALERT | COVID Relief Bill: Tax Credits for Paid Leave Extended to March 31, 2021
A new $900 billion coronavirus relief bill became law and extended the federal Emergency Paid Sick Leave (EPSL) and Emergency Family and Medical Leave (EFMLA).
Here’s what employers need to know:
• Offering EPSL and EFMLA after December 31 will become optional for employers.
• An employee will no longer be entitled by law to take EPSL or EFMLA, even if they have a qualifying reason.
• Employers who choose to offer these paid leaves can still receive a tax credit if they follow the current EPSL and EFMLA rules, including job protection.
• The extension of the tax credit will be available for leaves taken through March 31.
• Employees will not get new hours to use—the unused portion of their original allotment that remains on January 1 is how much they will be able to use through March 31.
• There is a possible exception when an employee’s EFMLA bank could reset if employers use the calendar year or another fixed FMLA tracking period that starts before March 31 and the DOL fails to readopt the regulations they wrote related to EFMLA (expect the IRS or DOL to provide guidance soon).
