One of my personal hot buttons is arbitration. Arbitration is used by credit card companies, and others, to work around trial by jury. Trial by jury in civil--non-criminal--maters is guaranteed by the Seventh Amendment. (And by many state constitutions, including Virginia.) With help from Congress and the Supreme Court, credit card companies, and others, use arbitration to dodge that requirement. This article explains how arbitration works in Baseball, under the MLB-Union contract. That arbitration is negotiated with the union, and is in a specialized area where a jury trial wouldn't make much sense.
When Congress originally passed the Federal Arbitration Act, things like baseball may be what some in Congress had in mind. But the Supreme Court has allowed it to spread in to consumer transactions, where you and I waive our rights in fine print that is never read or understood.
