Suit over man’s su***de proceeds A family’s lawsuit against a city, several of its police officers and a third-party EMS service filed after their son hanged himself will move forward in federal court.

They said it couldn’t be done…

I am very pleased and proud to present a winning opinion and order from Judge Paul Maloney in Kalamazoo/Western District of Federal Court on a 1983 failure to protect/zone of danger case against the City of Wyoming police officers. Our client, the deceased Jonathan Kostrzewski sadly ended his life on August 3, 2018 by hanging AFTER the police were called multiple times and had opportunities to get him help. This is an area of unsettled law in the 6th Circuit-meaning persons who are at risk of su***de whose interaction with law enforcement increases the risk of committing su***de and then indeed, helps them commit su***de successfully…usually lose when they sue cops called to help them make it more likely they will die.

But, the facts cried out, and we filed it, received the expected Motion for Summary Judgment on the pleadings…and Judge also granted our Motion to Amend to add a state law medical malpractice case against the ambulance company as well…So now we are allowed to engage in discovery and work towards a jury trial.

So proud of the brief authored by my brilliant associate Nick Gumina with a lot of work and months of effort & research by the Boss Lady (me)! Case No. 1:20-cv-00682-PLM RSK, Matthew Kostrzewski v City of Wyoming et al The opinion and order Is available on the federal website PACER for a full read. It is a honor to represent this family, and do what we can to make the law and policy in this area better, so calls to 911 result in help, not harm.

Some days your associate really makes you proud. Today’s one of those days. Tough case involving a severe lacrosse injury. Big firm predictably filed an MSD in lieu of Answer. That’s a legal way to say “no case” don’t let the plaintiff even go to trial and a jury. Nick Gumina did a great job of writing a fairly short but very scholarly brief (only 9 pages) that blew them away. 💪🏻 We take tough cases other firms won’t. We love the law.

This is terrible public policy-Republicans have fallen so far. "good" Economic numbers and a ready supply of bacon are worth more than human life.
Employers who hurt and even allow their employees to be killed are the last ones "who should not be subject to litigation" That is the last right under law most of these people have.
Without any form of accountabilty, they will continue to sacrifice human life for money. It's very simple.

Hello to my clients and friends! I hope you are all safely at home if you can be, and following Governor Whitmer’s order so we can get the COVID 19 virus slowed down and keep as many of us healthy as we can. My associate Nick Gumina and I are both working remotely from our homes and available by phone and email, as well as virtually available by ZOOM conferencing. While most of our courts are postponing trials, many hearings & even facilitations are being done by virtual teleconferences. Most trial courts are using skeleton staffs for the basic running of the Courts and our Supreme Court has extended many deadlines into May to accommodate the Governors’ very prudent order. We have continued to be able to settle cases, move forward on formal discovery, and yes, even file lawsuits for our injured and harmed clients! Rule of Law is more important now than ever. The passage of the so-called No Fault reform will only benefit insurance companies-it hurts consumers, the catastrophically injured, tax payers and employers who pay for health insurance. The Negligence Section of the State Bar, made up equally of defense lawyers and plaintiffs' lawyers has issued the best summary of why this is such a disaster. These are the people who know the law the best, and their practical and scholalry input was ignored.
