Your Complaint for Divorce must declare the grounds of your divorce. Deciding on whether to proceed with a fault or no fault divorce is one of the most important decisions you will make regarding your divorce. Whether to allege a fault ground is a question that only you and your attorney can answer after discussing your particular situation in detail. It may be possible that your case will be able to be resolved amicably by a property settlement agreement (PSA) and proceed on an uncontested basis, and your lawyer can help you determine how to begin negotiating to reach that goal.

Wishing you all a happy and productive Monday!

In the Commonwealth of Virginia, a protective order is a legal document issued by either a magistrate or judge that is intended to protect the health and safety of alleged victims of abuse including “any act involving violence, force, or threat that results in bodily injury or places that person in fear of death, s*xual assault or bodily injury”.

If you believe that you need to obtain protection for you or your family through the filing of a Protective Order, you should immediately consult with an attorney about whether the facts and circumstances of your situation are grounds to have a Protective Order issued, and to help you file to obtain such protection.

As part of your divorce, you will need to determine what you and your spouse’s respective interests are in each other’s retirement benefits. Retirement benefits are governed by both state and federal laws, and it is important that you understand the differences between how different types of retirement savings plans are valued and how they will be divided upon a divorce. Your attorney will help you identify what retirement assets are divisible, how to identify what portion of those assets you may be entitled to, and how best to structure any division so that it will result in the least tax consequences, the least amount of transfers, and ensure the division is done in a way that the plan will allow.

Virginia law recognizes that the needs of children vary through the course of their lives. For that reason, custody and child support orders are modifiable if there has been a material change of circumstances and if a modification of that order would be in the best interests of your children. In addition, depending on the language of your agreement or court order, there may be a term that is modifiable. It is important that you meet with an attorney who can review your documents and determine your specific needs.

If you need to modify your custody or child supoort orders, call us today: 703-683-9000.

If you share ownership of, or equity in a residence, you don’t forfeit your rights by moving out of the shared residence. However, the decision to live in a separate residence can be complicated and comes with its own legal and practical implications. We recommend discussing this with your attorney before you decide.

Consulting an attorney that focuses on family law and has experience and expertise dealing with these issues will greatly increase your chances of making decisions that lead to the best possible outcome.

Some states differentiate between protective orders and restraining orders. In Virginia, these terms are used interchangeably—though the proper legal name of the order is Protective Order.

If you believe that you need to obtain protection for you or your family through the filing of a Protective Order, you should immediately consult with an attorney about whether the facts and circumstances of your situation are grounds to have a Protective Order issued, and to help you file to obtain such protection.

Arbitration and mediation are both means of resolving your family law case without having to go to court.

If both parties elect to retain an arbitrator, who is almost always another attorney or a retired judge who sat on a bench on a local Virginia court, the parties and their attorneys will meet with the arbitrator and make the best case as to why they should prevail on each outstanding issue. The arbitrator will then rule on the issues, and that ruling will be binding on the parties.

The difference between arbitration and mediation is that in mediation, the mediator does not decide the case; the parties make the decisions themselves.

If you need help resolving your family law case, but don't want to go to court, call us today. Our attorneys are experienced in both arbitration and mediation.
