Trump reclassifies state-licensed medical ma*****na as a less-dangerous drug in a historic shift

Today is a historic day for cannabis policy.
The U.S. Department of Justice just issued a Final Order that immediately moves FDA-approved ma*****na products AND state-regulated medical ma*****na products into Schedule III under the Controlled Substances Act. After more than 50 years of Schedule I, this is one of the biggest federal shifts we’ve seen in our lifetime.
Why this matters (especially for finance + tax folks):
Medical operators (state-licensed) may finally get relief from 280E since Schedule III removes 280E’s punitive tax treatment for Schedule I/II businesses.
The DOJ also encouraged Treasury to consider retrospective 280E relief for prior years for qualifying medical operators.
Adult-use programs are still Schedule I (for now) — so the “medical vs. adult-use” distinction just got very real.
And this is just the beginning: DOJ also launched an expedited hearing process on broader rescheduling starting June 29, 2026.

The firms that move fastest on planning, entity structure, tax positioning, and compliance are going to have a serious edge.
