Estate planning for digital assets

Did you know that your online accounts – such as email, your Facebook account, airline and credit card rewards, financial accounts, digital music, and cryptocurrency – can be considered as an asset? More specifically, a digital asset access to which can be given to the Executor of your Will? If you pass away without a properly drafted Last Will and Testament that specifically deals with digital assets, most companies will refuse to give your loved-one’s access to these accounts.

The Problems With Do-It-Yourself Online Wills

If you are considering online services such as Legal Zoom to DIY your Will, please first consider the following:

1) Do you have a young child or teen as a beneficiary? If so, do you prefer they receive their inheritance in one lump sum or…? Typically, DIY Wills do not protect against young children and teen beneficiaries receiving a lump sum of cash that they may squander before they are old enough and responsible enough to manage money.

2) Do you have children from a prior marriage? How will you provide for your current spouse and your children upon your death? Do it wrong and your children may get nothing.

3) Do you know how to properly execute your Will? Hint: It involves more than just signing your name; and the improper ex*****on of a Will can render it invalid.

4) Do you know what should be included in your Will? Do you know what questions to ask to ensure your Will covers all your wishes? If you do not know the right questions and answers, it is impossible to ensure that your Will deals with everything it should.

5) Are you able to spot errors? Any mistakes in your Will become permanent once you die and may result in thousands of dollars in legal fees to resolve.

If you are uncertain about the answers to any of these questions, we encourage you to not risk jeopardizing your legal and financial health by preparing a legal document on your own. Preparing a Will can be complicated and saving a few dollars today by taking a shortcut may end up costing your family an enormous amount of money later. Changes to Medicaid Under the New York State 2020 Budget - Center for Elder Law & Justice

PSA: A major change is coming to Community Medicaid (Home Care) eligibility in New York.

There is currently no “look back” period to qualify for Community Medicaid. However, beginning October 1, 2020, New York will institute a 30-month look back period for all new Community Medicaid applications submitted on or after October 1st —roughly 5 months from now.

If you think you or your loved one may need help at home with performing activities of daily living (i.e. bathing, toileting, dressing, feeding, continence), and are concerned with how to pay for the care, we urge you to consider your options and take action in a timely manner. This change in eligibility could prove to be a costly and, perhaps, devastating change for those unaware of the new rules and who fail to take the necessary steps to plan and apply for benefits.

Prince's sister: He did not have a will

Failing to plan your estate, even if you are not an international superstar, can be a costly mistake. Prince's estate will likely owe in excess of $100 million in estate tax, not to mention the fighting that is guaranteed to ensue.
