In the example provided below there are 2 vehicles, both traveling next to each other, in the same direction, in separate lanes, on a two lane (in each direction) road. However, the right lane is about to end (as indicate by a roadway sign). Both drivers proceed forward, neither slowing down enough, or speeding up enough, to safely merge into the available lane and collide. Who do you think would be at fault?
