New Ruling from the SJC in Massachusetts- Property Managers are not allowed to file Summary Process to evict tenants:
GANTS, C.J. In 2016, Fred Basile, a property manager, brought a summary process action in the Housing Court in the name of his sole proprietorship, seeking to evict a tenant from a property for which he was neither the owner nor the lessor. Basile claimed that he was the manager for the property, and was acting as the agent of the owner when he filed the summary process complaint.
We hold that Basile had no standing to bring a summary process action in his name, where he was not the owner or lessor of the property. We also hold that, to the extent that he was acting on behalf of the true owner of the property when he filed the complaint, his conduct constituted the unauthorized practice of law because he was not an attorney.
We further declare that, where the plaintiff in a summary process action is neither the owner nor the lessor of the property, the court must dismiss the complaint with prejudice for lack of subject matter jurisdiction, regardless of whether a motion to dismiss has been presented by the defendant. Where the plaintiff is the true owner or lessor, but the complaint has been signed and filed by another person who is not an attorney, the court may either immediately dismiss the complaint without prejudice based on the unauthorized practice of law, or order that the complaint shall be dismissed on a designated date unless the plaintiff before that date retains counsel or proceeds pro se, and amends the complaint accordingly.
Finally, we hold that such conduct is not enough, on its own, to constitute an unfair or deceptive practice in violation of G. L. c. 93A. However, where a plaintiff seeks to evict a tenant without the standing to do so, or where a person who is not authorized to practice law signs and files a summary process complaint -- and where that conduct is not inadvertent but by design, or part of a pattern or practice -- we hold that a court has the inherent authority, in the exercise of its sound discretion, to impose appropriate sanctions, including attorney's fees and other costs, in order to ensure the fair administration of justice and to deter such conduct in the future.

I spent many summers attending the Lynn YMCA. The youth program was a safe place I could go and do fun things. During my time it was geared more towards the teenage crowd than that of the Boys and Girls Club (another great organization I was part of). I was lucky enough to learned about these programs through the DARE program. I learned how to swim, play table hockey, basketball and made many friends. I’m excited to see the new building and programs at the new Lynn YMCA. Please consider contributing to this great community asset.

Attorney Satterwhite has filed a class action lawsuit against the one of the largest debt buyers in the Country. Midland Funding, LLC has conducted business in the Commonwealth of Massachusetts for several years without meeting the general filing requirements set forth by the Corporations Division and thus they were unable to lawfully conduct business in the Commonwealth.
Midland Funding, LLC is a Foreign Entity, meaning they are not a domestic company in the Commonwealth. Midland Funding, LLC came to Massachusetts to sue our most vulnerable consumers on charged-off consumer debts throughout our Trial Court system.
Since filing the Midland Funding, LLC case in Suffolk Superior Court, Midland Funding, LLC has filed a Notice of Removal to the United States District Court for the District of Massachusetts.
In 2015 Midland Funding, LLC, “alone filed 32,009 civil, small claims, and supplementary process cases in the state’s District Court and Courts and in the Boston Municipal Court – more than one case in five. These cases, each of which names Midland as the plaintiff (or, in the supplementary process context, the “applicant” or “creditor”), consist of lawsuits seeking to establish liability to Midland on consumer debt accounts purchased by Midland; post-judgment lawsuits seeking wage attachments against judgment debtors; post-judgment lawsuits seeking property attachments against judgment debtors; and post-judgment supplementary process actions seeking payment orders against judgment debtors.” Testimony of Massachusetts Law Reform Institute, National Association of Consumer Advocates, and National Consumer Law Center, on behalf of its low-income clients on October 18, 2016.

Judge: Lynn's housing court is moving to Salem - Itemlive
It is a sad day for "Lynn Housing Court" and the Lynn community, but a good year for the citizens of the Commonwealth of Massachusetts that have housing-related issues.
In July of 2017, the Housing Courts extended to reach every single community in the Commonwealth of Massachusetts. Before July of 2017, as just one example, people living in Revere and Chelsea did not have access to Housing Courts. Housing matters were handled by the District Court without the right to transfer to a Housing Court. Several other communities in the Commonwealth of Massachusetts had the same Housing Court void. District Courts can still hear housing matters, including Lynn District Court.
Chief Justice Timothy Sullivan, my former law school professor, had to make a decision on a budget. He decided to extend Housing Courts, with the authorization of the legislative bodies, to all people in the Commonwealth of Massachusetts. Unfortunately, Lynn has lost its housing session in the mix.
Lynn Housing Court uses the Lynn Juvenile Court's space, once a week (Tuesday), and has a healthy amount of cases. Lynn Housing Court is only a session of the Northeast Housing Court that is located in the Fenton Judicial Center in Lawrence. Lynn, Salem, and Lowell are all considered sessions of the Northeast Housing Court (headquartered in Lawrence). If you have an emergency motion and it is not a day in which a session is held in Lynn or Salem or Lowell, it must be heard in Lawrence, where there is a housing judge always available.
The Salem session is in the J. Michael Ruane Judicial Center and has a designated clerk's office and courtroom. The J. Michael Ruane Judicial Center houses the Essex Superior Court, Salem District Court, and Salem Juvenile Court.
Salem has worked its way into becoming the defacto "southern" house of Essex County business (superior court, the registry of deeds, sheriffs office etc). This happened even though Lawrence is the largest city in "northern" Essex County and Lynn is the largest city in "southern" Essex County.
This move would make sense if Salem is open full time, with a housing judge and clerk and as the southern headquarters of the Northeast Housing Court. This would bring more benefits to the "southern" Essex County community.
