[05/08/20]   It's pretty far in advance, but I am pleased to announce that I will be speaking in an upcoming Strafford live Continuing Legal Education webinar, "Virtual Real Estate Closings: Verification, E-Signature, Remote Notarization, Best Practices and Procedures" scheduled for Tuesday, July 7, 1:00pm-2:30pm EDT.

Shelter in place and social distancing caused states to ease restrictions on requirements for in-person real estate closings. Although some practitioners regularly use remote closings, the COVID-19 world requires this to be the rule rather than the exception. Counsel must meet the needs of all parties to the transaction: the buyer, seller, lender, and insurance company.

Closing attorneys must always be vigilant in their review of due diligence, but virtual transactions create the potential for increased fraud. Examination of both the documentation from organizational documents to title commitments is essential. Attorneys should prepare to question and screen the reasoning behind omissions and exceptions not previously considered to meet the requirements of lenders and title insurers.

Counsel should discuss with parties the use of technology, the limitations of privilege, and the pros and cons of conducting a closing utilizing one of the video conference platforms.

Although closing with original signatures may prove impractical and/or result in delays to the closing process, attorneys must determine if their clients will accept "electronic signatures." Additionally, many states have provided a new option of remote notarization in limited circumstances. Given the rapidly shifting environment, counsel must comply with new state law and meet the requirements from the title company insuring the transaction regarding the recordability of such documents based on the local governments' potentially changed policies.

Our panel will provide real estate attorneys and other real estate professionals with current guidance on the changes related to closings in a social distancing environment. As several states have eased regulations regarding closings, counsel must clarify what is required, as well as best practices related to verification of parties, e-signatures, and remote notarization while complying with the requirements of lenders and title insurance companies.

We will review these and other key issues:

Determining what the parties require for a closing to be insured and lender approved
Vetting documentation and when to question missing information
Choosing the best technological format for a virtual closing
Ensuring that e-signatures and remote notarization is valid in each state where the transaction is taking place
Best practices and procedures for conducting a virtual real estate closing
After our presentations, we will engage in a live question and answer session with participants so we can answer your questions about these important issues directly.

[02/03/18]   Did you know it’s probably not a good idea to sell your home by yourself ? Don’t do FSBO . Use a realtor to sell your home . You will get more people seeing your home in person and you will have the access of multiple listing (meaning many other people acting on your behalf to sell your home ) and you will get pre-qualified applicants . What else ? You will get time because you won’t have to find time in your crazy days to show the house yourself letting non-screened strangers into your house. You will get more money even after you pay their commission . Hire someone you like , someone who knows your neighborhood, your schools, and the best pizza joints in town. Someone who will be straight with you and value you and your opinion . Someone who won’t force “their people” down your throat but will refer you to trusted advisors and tradespeople (inspectors, expediters, attorneys, contractors, etc) who are there to help you, not simply people who will give the agent an illegal kickback for the referral . This is a seller’s market.... use your patience and control to your advantage now and hire a realtor ...

[01/25/18]   SURVEY SURVEY ON THE WALL, WHO HAS THE GREATEST BOUNDARY OF ALL.

I'm going to repeat the gist of this one..

A couple of months back, I finished up a sale of my friends' old house, and then his purchase of a new house an hour or so later.

The sale was highlighted with a boundary dispute with a neighbor, who despite living next door for over 17 years decided to not only raise the issue about their common boundary with fence after all this time, but filed a lawsuit about the boundary which held up the closing, and increased the cost. Ridiculous, right?

Well.... turns out the fence was on the boundary line and correct all along, but at a cost of bad blood, aggravation, and thousands of dollars later. Lesson? Get a new survey guaranteed to the title company, your lender, and yourself when purchasing a new home. The cost will vary according to the size of the lot and house, but it should be about $700 in most cases. If you already own a home and don't have a survey be sure to get one before you put up any fences, hedges, etc. Any questions, feel free to contact me.

[01/22/18]   How do I differentiate myself from other attorneys? I'm a regular person who happens to be an attorney. There are many attorneys who put on their "attorney face" all the time. I don't want to do that. I hope it comes through when we you call me, or text me. I hope it comes through to the other attorney when we negotiate a contract, and I hope it comes through when I'm negotiating the terms of your loan workout with a lender.
