I was just served by a marshal with temporary restraining order paperwork... what should I do?

First and foremost, read the order of protection carefully and be sure to obey all of the terms and conditions of protection. Rest assured that the temporary orders are issued on an "ex parte" basis meaning that the Judge has only heard one side of the story thus far, but has made a preliminary finding that you present a continuous threat of physical pain or physical injury, stalking or a pattern of threatening to the protected person. Many temporary restraining orders are issued as a precaution. You will have an opportunity to present your version of the events within 14 days at a hearing. It is crucial to speak with an attorney who will read the affidavit carefully, gather evidence while it is available, and develop aggressive defenses to the allegations. There may also be criminal consequences depending upon the claims. While many claims are valid, restraining orders are sometimes used to gain a strategic advantage in divorces and custody cases. Can moving out of the home have an effect on which party is awarded residential custody?

This is an often overlooked question in family court. Most clients are aware that moving out of the home before or during a divorce can have financial implications, but the custody/visitation component is often overlooked. Courts tend to favor stability when making custody/visitation determinations. Moving out of the home, perhaps out of town, and into a smaller apartment or condo with a roommate for example, could be detrimental to your case for residential custody and may even have an impact on visitation in general. When I get divorced, how does the Court determine which parent gets to spend the holidays with the children?

Its always easiest if the parents can agree on a holiday visitation schedule without the Judge deciding. Typically, the parents will agree to split the day with the children on holidays such as Thanksgiving and Christmas whereas holidays such as Halloween and Christmas Eve generally lend themselves to being rotated on a yearly basis. If the parties cannot agree, a Judge will order a holiday schedule based on what is in the best interests of the children. The Court may base its decision on factors such as each party's unique holiday traditions, what the child has been accustomed to in the past, and how far the parties live apart.

Does my ex-fiance get to keep the engagement ring even though the wedding never took place?

Generally speaking, a gift to another person cannot be legally revoked by the giver. However, sometimes courts make an exception to this rule when the gift is conditional, such as an engagement ring being gifted on the condition that a marriage occurs.
