CALIFORNIA EMPLOYERS

Employers in California are now required to register for the new CalSavers program by June 30th. This program allows employees to use payroll deductions to invest in their retirement at no cost to the employer. Registration can be done on the CalSavers website. After registering, employers have 30 days to provide basic employee roster information. CalSavers will then contact your employees and provide them will all the information they will need to register or opt out. Employees will be automatically registered after 30 days, but may opt out or change deduction amounts at any time.

Employers that already sponsor a qualified retirement plan can file an exemption on the CalSaver’s website.

Wage Law Change (NYC)

The new Salary Disclosure Law requiring employers to include potential wages in job postings for certain NYC positions has been amended and will take effect on its new date November 1, 2022.
The Amended Legislation modified the law in the several important ways.
1. The Salary Disclosure Law will not apply to positions “that cannot or will not be performed, at least in part” in NYC.
2. The law will also only require revelation of annual or hourly wages. Other forms of compensation, such as bonuses and benefits, are not required to be divulged.
3. Only current employees will have private right of action in relation to advertisements for a job or transfer opportunity with their current employer.
4. As long as employers submit proof that a violation has been resolved within 30 days of a complaint from NYCCHR.
5. “General notices that an employer is hiring without reference to any particular position” will not be exempt.

NYC employers should consider reviewing which roles are expected to be performed, at least occasionally, from NYC and determine and document salary ranges for those positions. Check and review existing job posting templates and updates for use beginning November 1, 2022, making sure to communicate and train applicable supervisors/department heads on the implications of the new law. It’s also strongly suggested all NYC employers conduct a pay equity audit of their operations and monitor the Commission for new guidance.
