Imagine spending decades paying for your home, building equity, and believing that value belongs to you, only to lose the property over unpaid taxes and potentially lose far more than the amount actually owed.

The U.S. Supreme Court made an important distinction in Tyler v. Hennepin County: government may collect a legitimate tax debt, but keeping value beyond what is actually owed can raise serious constitutional concerns.

You May Not Control These Parts of Your Property the Way You Think You Do.

Your mailbox.
The sidewalk.
The strip of land between the sidewalk and the street.
Utility easements.
Drainage areas.
Alleys.
The curb.
Street trees.
Access points near the roadway.

Many homeowners look at the front of their property and assume, “That is mine.”

But property ownership is often more complicated than that.

A city, county, utility company, postal service, HOA, or other entity may have rights to access, regulate, maintain, repair, or restrict certain areas connected to your property.

For example, the area between the sidewalk and the street is often subject to a public right-of-way, even when the homeowner may still have maintenance responsibilities.

Utility easements may allow companies to enter certain portions of the property to service lines, equipment, or infrastructure.

Sidewalks may be regulated by local government even when the adjoining property owner is responsible for upkeep.

Mailboxes must also comply with postal placement and access requirements.

So the real question is not just:

“Is it on my property?”

The better question is:

“Who has legal rights, easements, access, or regulatory authority over it?”

Understanding the difference between ownership, control, possession, easements, and public rights-of-way can completely change how you look at your property.

Know your boundaries.
Know your easements.
Know your rights.
Know your responsibilities.

"Your “No Trespassing” sign may not protect your land the way you think it does.

Under the federal “open fields” doctrine, much privately owned land can still be entered and searched by government officers without a warrant—even when the property is fenced or posted. The Institute for Justice estimates this doctrine leaves about 96% of private land in the U.S., roughly 1.2 billion acres, exposed to warrantless searches.

But that is changing in some states.

In July 2026, the Pennsylvania Supreme Court unanimously ruled that warrantless searches of posted private land violate the Pennsylvania Constitution when the owner has taken sufficient steps to exclude intruders.

And in April 2026, Idaho enacted a law requiring most government agents to obtain a warrant, consent, or rely on a recognized emergency before entering private land closed to the public.

So the real question is not just: “Do you have a No Trespassing sign?”

It is: What protections does your state actually give your land?

Know the law. Know your property rights. Know what steps matter in your state.

🚨 THE CLOSING TABLE TRAP 🚨

Most people walk into a real estate closing believing they are about to become the true owner of their property.

They sign the paperwork.
They accept the keys.
They begin making payments.

But did anyone clearly explain the deed, the vesting language, the legal description, the title exceptions, or exactly what rights were transferred?

The closing table is where buyers are often rushed through stacks of documents they did not prepare, may not fully understand, and are expected to sign within minutes.

Before you sign, ask:

✅ How is ownership being vested?
✅ What type of estate is being conveyed?
✅ Are there restrictions or exceptions in the title?
✅ Does the deed accurately identify the land?
✅ What obligations are being accepted?
✅ Were the documents reviewed before closing day?

A closing should not be the first time you see the documents controlling one of the largest purchases of your life.

Slow down. Read everything. Ask questions. Understand what you are accepting before your signature goes on the page.
