On May 22, Secretary of Homeland Security Alejandro Mayorkas announced in a press release that the Temporary Protected Status (TPS) designation for Haiti has been extended for 18 months with a new eligibility date. This designation enables Haitian nationals and those who last resided in Haiti to file initial applications as long as eligibility requirements are met.

Victory for SIJ (Special Immigrant Juveniles) applicants between the ages of 18 and 21 in New York!! U.S. Federal Court for the Southern District of New York just ruled that USCIS's latest policy to deny SIJ for youth over the age of 18 violated the APA and should be reversed! A proposed rule from the Trump administration will make it harder for legal immigrants to obtain green cards if they have received certain kinds of public assistance, such as Medicaid, food stamps, and housing subsidies. This proposal marks a new beginning in the administration’s long-term effort to control both legal and illegal immigration.

But what effect will this proposal have?

What exactly is the White House proposing? The Trump administration wants to redefine a status known as “public charge” – a category used to determine whether someone seeking permanent resident status is “likely to become primarily dependent on the government for subsistence.” Public charge has been part of U.S. immigration law for more than 100 years is a ground of inadmissibility and deportation. An individual who is likely at any time to become a public charge is inadmissible to the United States and ineligible to become a legal permanent resident. However, before Trump’s proposal, receiving public benefits would not automatically make an individual a public charge.

In the past, people were at risk of being defined a “public charge” if they received cash welfare, such as Temporary Assistance for Needy Families (TANF) or Supplemental Security Income (SSI). This public charge designation could compromise their applications for permanent residence.

The new rule would expand this list to include some forms of health insurance, food, and housing programs. Specifically, it would penalize applicants using Medicaid, a federal-state health plan for low-income families. Additionally, using food stamps, Section VIII rental assistance, and federal housing vouchers would also count against applicants. Further, enrollment in a Medicare Part D plan to help low income people buy prescription medications may also adversely impact green card seekers.

The Trump administration claims the proposed rule is intended to promote immigrant self-sufficiency and protect finite resources.

This proposition is unprecedented. Public charge is an old idea. However, including programs like Medicaid and food stamps, is a significant change. Trump’s proposition would more likely hit working people, as the majority of people on Medicaid are employed, according to data complied by the Kaiser Family Foundation.

Experts maintain that children who are American citizens but whose parents are immigrants may be more likely to suffer repercussions. It is predicted that immigrant parents will opt out of public assistance for fear of their own legal status and that their children will be less likely to be enrolled in assistance programs, such as the Children’s Health Insurance Program, for which they would qualify.

It is important to note that receiving public assistance would not necessarily stop people from obtaining green cards. However, it would shift the odds significantly against them.

When will the policy shift take effect? To date, it is early in the federal rule making process, and much could still change. Once the proposed rule appears in the Federal Register, the official journal of the federal government of the United States that contains government agency rules, proposed rules, and public notices, a 60-day countdown starts, during which anyone can weigh in with comments. A final rule would not be expected to take effect until 2019.

The proposal may be already impacting low-income immigrants. The Department of Human Services (DHS) estimates that 2.5 percent of eligible immigrants will drop public benefits programs because of this change. There are already reports of people declining public assistance, even though nothing has yet happened because of the proposal.

DHS predicts that the refusal of public benefits will lead to worse health outcomes, increased use of emergency rooms, increased prevalence of communicable diseases, and increased rates of poverty.

Legal action is likely. Officials are currently weighing challenges to the rule. However, future legal actions will depend on the final form of the regulation.
