The New Colossus

Not like the brazen giant of Greek fame,
With conquering limbs astride from land to land;
Here at our sea-washed, sunset gates shall stand
A mighty woman with a torch, whose flame
Is the imprisoned lightning, and her name
Mother of Exiles. From her beacon-hand
Glows world-wide welcome; her mild eyes command
The air-bridged harbor that twin cities frame.
"Keep, ancient lands, your storied pomp!" cries she
With silent lips. "Give me your tired, your poor,
Your huddled masses yearning to breathe free,
The wretched refuse of your teeming shore.
Send these, the homeless, tempest-tost to me,
I lift my lamp beside the golden door!"

W. Whitfield Hyman, Attorney at Law

Is it legal to take bets on the outcome of a case? Does anyone know a good lawyer I can ask?

I was here representing the Libertarian Party of Arkansas ( www.facebook.com/lp.arkansas ) today trying to have Arkansas election laws declared unconstitutional with legendary election law attorney Jim Linger.
The state of Arkansas had 6 attorneys from the Attorney General's office, a paralegal, and two expert witnesses charging $350 an hour (for the whole day) as well as at least two attorneys from the Secretary of State's office (1 as a witness). There were at least four more Arkansas employees from those offices in the galley, and the general counsel for the Republican Party of Arkansas was looking on.
All for lil' old us. I think Dr. Michael Pakko (president of the Arkansas Libertarian Party) and retired public school teacher and volunteer firefighter Michael Kalagias were enough to counter all of that.

Mr. Hyman please report to work immediately for a randomized drug test... Just kidding ;)

The police just gave me some meth to look at. Cool.

"One meth please."

I won a civil rights lawsuit today in the 8th Circuit (unless they appeal).
If you are arrested for yelling "f*** you" while driving by a police officer, that violates your first and fourth amendment rights.
I don't agree with the speech but I am appalled that a police officer would arrest someone for hurting his feelings and expect tax payers to pick up the tab. I have been cussed at many times and never felt the urge to put any of those people in a cage.*
The case continues to move forward, but the officer is still getting tax payers to pay his attorneys to defend the case.

*Well, I never acted on the urge to put them in a cage.

It looks like our appellate practice just got more efficient.

Yes, we do a variety of state civil and criminal appeals! Send us a message if you have questions about your case.

Big changes in appellate practice yesterday. No more abstracts or addendums it looks like. I'll have to read this in detail later.

This was the most boring part of my job and it is gone. FeelsGood.jpg

Basically we used to have to condense the record and it would take days and was mindless drone work. Unfortunately an attorney still had to do it because you could write it in a way that made your side look a teensy bit better. I think we were the only state that required this.

Frustrated with immigration? So is the government. USCIS is being investigated for their slow processing times.

The backlog at USCIS is so bad that the government is investigating.

Career day. I tried to explain the statute of limitations, all they heard was they can steal candy bars and get away with it if they can not get caught for ten years.

I tried to explain the first amendment and all they heard was you can yell from your car at a police officer while driving away and it isn't illegal.

Some kid asked me how I get paid and what type of cases I do. I told him one time I got paid in guns to defend a guy who was caught with guns he couldn't legally have. That off hand comment in twenty five minutes of talking is what he focused on.

I'll try better next time...

Federal judge’s order staying deportations for refugees and others with valid visas

To immigrants affected by Friday's executive order (from Iran, Iraq, Libya, Sudan, Somalia, Syria, Yemen): you have rights. Know them.

1. If detained at an airport under Executive Order call the local ACLU for that area, or any local attorneys writing habeas corpus petitions. Some airports, such as JFK in New York, have attorneys rushing in to provide this service pro bono. If you have an immigration attorney, call them. If you need an immigration attorney, call us at 479-782-0049, or email us at [email protected] We will consult you on these issues for free. Additionally, call the Congressman/Senator's office for the state in which you live and ask to speak to the constituent liaison. They may have a form they can send you to fill out that would allow your Congressman or Senator to act on your behalf.

2. If you end up being held because you are a national on the list of affected countries, print out a copy of the stay order and show it to anyone trying to coerce you into talking to them or signing something http://documents.latimes.com/deportations-stay-trump/. The stay is temporary but effective immediately and nationwide.

3. If officials will not honor the stay, take detailed notes, get names and badge numbers, details about the length of time you were held, where you were held, any adverse conditions, and any abuse you suffered and everything anyone said to you. Keep demanding access to counsel and do not sign anything.

4. For lawful permanent residents who are coming back to the U.S., under no circumstance should you sign a I-407/ Record of Abandonment of Lawful Residence. CBP will coerce/trick people into doing this as a condition of release from detention. You should similarly, take notes, ask for a lawyer, and demand to see an immigration judge.

5. For those from designated countries, do not travel abroad. You risk denial of re-entry.

6. For those persecuted in their home countries or fear of persecution in countries CBP would return them to, demand a credible fear interview at ports of entry. Find an immigration attorney and ask about the asylum process.
