Welcome to Grafe & Batchelor, P.C. We are a Jefferson County criminal defense firm located in Festus, Missouri. We represent clients charged with alleged crimes in state, county and municipal courts in Jefferson and various surrounding counties. These offenses range from minor traffic tickets to serious felonies and everything in between – no case is too big or too small. You will have over 25 years of criminal defense experience in your corner. We do not have associates. We will personally appear in court on your behalf and personally return your phone calls. We are dedicated criminal defense attorneys first and foremost. While we do practice in a few other select areas of law (see PRACTICE AREAS) criminal defense and its related fields are where we focus our experience and passion. We are not and will never be the "low cost leader". We believe the old adage that "you get what you pay for" also applies to hiring any attorney, especially for something as critical as criminal defense. We will never tell you simply "what you want to hear" to sell our services. We believe our reputation in the criminal defense community, and most importantly among former clients, speaks for itself. Please contact us at (636) 933-9151 to schedule your consultation. We look forward to hearing from you and offering our assistance. This web site is designed for general information only. What is a DWI?

According to legislation, if the BAC (blood alcohol level) of a driver reaches 0.08% during a test, there is no other evidence of impairment required for a DWI conviction. Punishments here may include suspension of the driver’s license and implied consent to ongoing tests for drugs and alcohol. The next stage is ‘aggravated DWI’ – this is employed if the driver’s blood-alcohol level exceeds 0.15%. The penalties for this are harsher and may include a total ban or even a custodial sentence.

Missouri law states that it is a legal requirement to report an auto accident in almost all situations. There are two examples where reporting is a must, and these are:

❎Any accident which results in an injury, fatality, or property damage in excess of $500

❎Any accident with an uninsured driver, whether this occurs in a street, highway, or a parking lot. In the event that the uninsured driver is found to be at fault, they will be found liable for two offences: negligence, causing injuries to the other party, and also driving without insurance

❎Any accident involving a parked car – the owner is required to report if the accident results in injury, fatality, or property damage over $500
